UNKNOWN HEIRS, FIDUCIARIES, BENEFICIARIES, DONEES, DEVISEES, AND/OR SPOUSE OF MICHAEL A. JOHNSON, DECEASED, ET AL
DEFENDANTS.
Unknown Heirs, Fiduciaries, Beneficiaries, Donees, Devisees, and/or Spouse of Michael A. Johnson, deceased; Barri D. Clark and Unknown Spouse of Barri D. Clark, whose address is unknown, are hereby notified that First National Acceptance Company, filed a Complaint in the Common Pleas Court, Mahoning County, Ohio, in Case No. 16CV 1375 against them, alleging that on the October 18, 2007, Michael E. Johnson and Barri D. Clark executed to First National Acceptance Company a land installment contract; and that the payments are in default, and there is due Plaintiff thereon the sum of $6,950.92 with interest at the rate of 9.875% from December 3, 2015; the Plaintiff is entitled to terminate the contract and foreclose on the following described real estate:
Situated in the City of Youngstown, County of Mahoning, and State of Ohio and known and described as follows, to wit:
And known as being Lot Number Twenty-Five Thousand Three Hundred Twelve (25,312) according to the latest enumeration of lots in said City as recorded in Volume 16 of Plats, Page 210, Mahoning County Records.
Said Lot has a frontage of forty (40) feet on the east line of Shady Run Road and extends back on its north line one hundred fifty-three and five tenths (153.5) feet, and on its south line one hundred fifty-three and four tenths (153.4) feet, having a rear line of forty (40) feet, as appears by said plat.

PROPERTY ADDRESS: 2613 Shady Run Road, Youngstown, Ohio 44502.
Plaintiff says that the General Warrant Deed was delivered to the Recorder of Mahoning County, Ohio on July 12, 2010 and was recorded in OR Book 5862, Page 1225, and states that the Plaintiff is the owner of said property.
That by reason of the failure of Michael E. Johnson and Barri D. Clark to make the monthly payments as required the Plaintiff has declared the land contract is in default by its terms and moves the Court for an order and entry of foreclosure.
Plaintiff further states that the Treasurer of Mahoning County, Ohio may have a claim against said premises. Plaintiff futher states that Unknown Heirs, Fiduciaries, Beneficiaries, Donees, Devisees and/or Spouse of Michael A. Johnson, deceased and Unknown Spouse of Barri D. Clark, may have a claim against said premises.
Therefore, Plaintiff prays for "in rem" judgment in the amount of $6,950.92 with interest at the rate of 9.875% from December 3, 2015 and that the mortgage set forth in the Second Cause of Relief be foreclosed and all equities of redemption be forever cut off; that the priority of all liens be determined by this Court; be sold as upon execution free and clear of all liens, interest and dower, and the proceeds thereof applied to the Plaintiff's claim set out in the foregoing complaint and the Plaintiff may have such other and further relief to which it may be entitled at law or in equity.
Defendants first hereinabove named are further notified that they are required to answer said Amended Complaint on or before September 13, 2016. which includes 28 days from the last publication or judgment may be rendered as prayed for therein.
