DEFENDANTS.

The Estate of Mary F. Schoch aka Mary Frances Schoch, deceased, Unknown Spouse, if any, of Mary F. Schoch, deceased, Unknown Heirs, Devisees, and Legatees of the Estate of Mary F. Schoch, deceased, and the Unknown Executor of the Estate of Mary F. Schoch, deceased, whose addresses are unknown and who cannot be served within the State of Ohio, will take notice that Plaintiff filed a Complaint in Mortgage Foreclosure in the Court of Common Pleas of Mahoning County, Ohio on May 6, 2015 in Case No. 15CV 1227, against the Estate of Mary F. Schoch, et al, Defendants, alleging that on or about September 16, 2004, Plaintiff extended a loan to Mary F. Schoch, who is now deceased. Pursuant to the loan, Mary F. Schoch, executed and delivered to Plaintiff an Adjustable Rate Note, in the amount of $66,298.00, a copy of which is attached to the Complaint as Exhibit "A"; that Plaintiff is the holder of the Note, upon which there is due and owing the principal balance of $54,526.89, plus interest at 4.5% per annum from June 16, 2014, unpaid late charges, escrow shortages, and costs; that Mary F. Schoch died on August 1, 2014, and to date no estate has been filed; that to secure payment of the Note, Mary F. Schoch executed and delievered to Plaintiff a Mortgage, and thereby conditionally conveyed the following-described real property:

Situated in the Township of Austintown, County of Mahoning and State of Ohio, and Known as being Lot No. One Hundred Nine (109) in Timberlanes No. 2 as recorded in Volume 40 of Plats, Page 18, Mahoning County Records.

Said lot has a frontage of 90.41 feet on the south line of Monaca Avenue and extends back on its west line 195.03 feet and on its east line 215.9 feet, having a rear line of 90.67 feet, as appears by said plat, be the same more or less, but subject to all legal highways.

PROPERTY LOCATION: 3885 Monaca Drive, Youngstown, Ohio 44511.

that the Mortgage was recorded in OR 5475, Page 220, Mahoning County Records, a copy of which is attached to the Complaint as Exhibit "B", that the Mortgage is the first and best lien against the subject real estate, after the lien of Defendant Mahoning County Treasurer for real estate taxes; that the Note secured by the Mortgage is in default for lack of payment, the conditions of the Mortgage have been broken, the Plaintiff is the holder of the Mortgage and Plaintiff is entitled to have the Mortgage foreclosed; that Defendant Mahoning County Treasurer holds a claim on the subject real estate for real estate taxes; that Defendants Estate of Mary F. Schoch, Unknown Spouse, if any, of Mary F. Schoch, Unknown Heirs, Devisees, and Legatees of Mary F. Schoch, Unknown Executor of the Estate of Mary F. Schoch, and Current Tenant, if any, of 3885 Monaca Drive, Youngstown Ohio 44511 may have or claim to have interests in the real estate; and that Defendants First National Bank of Pennsylvania and State of Ohio, Department of Job and Family Services, may have or claim to have liens against the real estate. The Complaint demands that the Defendants named therein be required to appear in this suit and set forth whatever interests they may have in the real property or be forever barred from asserting the same; that there is due and owing to Plaintiff on Note the amount stated above, and that judgment in foreclosure be entered in favor of Plaintiff in said amount; that Plainitff be found to have the first and best lien against the real estate, after the lien of Defendant Mahoning County Treasurer for real estate taxes; that it be found that the conditions of the Mortgage have been broken and that Plaintiff is entitled to have the lien of the Mortgage foreclosed, and the premises appraised and sold in this action, and the proceeds applied to the satisfaction of Plaintiff's Mortgage in its proper priority; that Plaintiff receive its costs in this action; and that the Court grant such other and further relief as equity and the nature of the case may require.

Defendants, Estate of Mary F. Schoch aka Mary Frances Schoch, Unknown Spouse, if any, of Mary F. Schoch, deceased, Unknown Heirs, Devisees and Legatees, of the Estate of Mary F. Schoch, deceased, and Unknown Executor of the Estate of Mary F. Schoch, deceased, are further notified that they are required to answer said Complaint with twenty-eight (28) days of the last publication of this notice and set forth whatever interests they may have in and to the above-described real estate or be forever barred from asserting the same, said answer day being the 25th day of August, 2015.
