Bittner Development Company, whose exact address cannot be ascertained with reasonable diligence, shall take notice that, on the 12th day of April, 2013, Plaintiff, Tiger Land Holdings, LLC, filed its Complaint in Foreclosure in Case No. 13CV 1000 in the Court of Common Pleas, Mahoning County, Ohio to foreclose the liens held by it for delinquent real estate taxes, assessments, penalties, interest, charges and costs with respect to the following parcel of real property:
Tax Parcel 36-003-0-096.000
Situated in the Village of Poland, County of Mahoning and State of Ohio, and being a part of Village Lot No. 392, bounded and described as follows:
Beginning at a point in the original center line of Water Street, that is N. 36° 00' E., a distance of 110 feet from the northeasterly corner of Lot No. 157; thence N. 36° 00' E. along the original center line of Water Street a distance of 309.75 feet to the center line of Cemetery Road, thence N. 74° 19' E., along the center line of Cemetery Road a distance of 206.55 feet to a point; thence S. 71° 42' E. along the center line of Cemetery Road a distance of 200.33 feet to a point; thence S. 9° 19' W., a distance of 297.82 feet to a point; thence N. 61° 42' E. a distance of 15 feet to the low water line of Yellow Creek, thence S. 33° 52' E. along the low water line of Yellow Creek a distance of 251.6 feet to a point; thence N. 61° 42' W. a distance of 35.4 feet to the center line of Yellow Creek; thence S. 57° 30' W., along the center line of Yellow Creek a distance of 18.86 feet to a point; thence N. 53° 11' W. along the northeasterly line of R.L. & E. McBride a distance of 404.95 feet to the place of beginning and containing within said boundaries 4.932 acres of land more or less.
Subject however, to easements for highway and drainage purposes, granted to the Department of highways of the State of Ohio, in Case No. 151784 in the Common Pleas Court of Mahoning County.
The prayer of the Complaint is for an order transferring fee simple title to the property to Plaintiff, free and clear of all subordinate liens. Alternatively, the prayer of the Complaint is for an order directing that the property be sold at public auction and that the proceeds therefrom be used to satisfy Plaintiff's liens. Plaintiff further prays for such other relief as the Court may deem just, equitable, and necessary, that any and all persons claiming an interest in the property be required to answer and set up their interest or be forever barred from asserting the same, that Plaintiff's liens be found to be good and valid first liens on the property, and that the equity of redemption of the property be foreclosed.
The above-named Defendant is required to answer Plaintiff's Complaint within twenty-eight (28) days after the last date of publication of this notice, which notice shall be made once per week for three consecutive weeks, said answer day being the 25th day of October, 2013. If said Defendant fails to timely respond, the Court may enter a default judgment against them for the relief requested in the Complaint.
