Unknown Heirs, Assigns, Legatees, and Devisees, of Peter J. Marcelle, Jr., whose last known address is unknown, and who cannot be served, will take notice that on the 3rd day of June, 2013, IFreedom Direct Corporation aka IFreedom Direct Corp., filed an Amended Complaint for Money, Foreclosure and Equitable Relief in the Mahoning County Court of Common Pleas, Mahoning County, Ohio, Case Number 13CV 658 against Unknown, Heirs, Assign, Legatees, and Devisees of Peter J. Marcelle, Jr. and others as Defendants, alleging that, on or about April 25, 2012, Peter J. Marcelle, Jr. executed and delivered a mortgage note ("Note"), in writing, in the original amount of $43,822.00; that payments are in default and the the Mortgage has therefore become absolute; that on April 25, 2012, Peter J. Marcelle, Jr., executed and delivered a certain Mortage Deed in which said Defendant agreed, among other things, to pay the Note and to Comply with all of the terms of the Mortgage Deed hereinafter described, which Mortgage Deed was filed in the Recorder's Office of Mahoning County, Ohio on April 27, 2012, recorded as Instrument Number 201200011759 and that, further, the balance due on the Note is ($43,285.35) with interest at the rate of (4.500%) per annum from September 1, 2012; that to secure the payment of the Note, Peter J. Mercelle Jr., executed and delivered a certain mortgage Deed to and thereby conveying, in fee simple, the following described permises:
Situated in the State of Ohio, in the County of Mahoning and in the City of Youngstown:
and known as being Youngstown City Lot No. 55938 according to the latest enumeration of lots in said City and as shown recorded in Volume 28 of Maps, Page 189, Mahoning County Records.
PROPERTY LOCATION: 72 South Hartford Avenue, Youngstown, Ohio 44509.
PERMANENT PARCEL NO.: 53-167-0-086.000
And further alleging that the aforesaid Mortgage is a valid and subsisting first and best lien upon said premises after the lien of the Treasurer; that the Note is in default, whereby the conditions set forth in the Note and Mortgage have been broken, that the Mortgage has become absolute and that Plaintiff is entitled, therefore, to have the Mortgage foreclosed, the premises sold, and the proceeds applied in payment of Plaintiff's claims; that the Defendants, Unknown Heirs, Assigns, Legatees, and Devisees, of Peter J. Marcelle, Jr. among others, may have or claim to have some interest in or lien upon said premises; that all of the Defendants are required to set forth any claim, lien or interest in or upon the premises that he, she, or it may have or claim to have or be forever barred therefrom; that Plaintiff's Mortgage be declared to be a valid and subsisting first and best lien upon said premises after the lien of the Treasurer, if any, that its Mortgage be foreclosed; that all liens be marshalled; that the equity of redemption of all Defendants be forever cut off, barred, and foreclosed; that upon the sale of said premises the proceeds, be paid to Plaintff to satisfy the amount of its existing lien and the interest, together with its disbursements, advancements, and cost herein expended; and for such other and further relief to which is may be entitled in equity or at law.
Defendants are further notified that they are required to answer the Complaint on or before the 16th day of August, 2013 which include twenty-eight (28) days from the last publishing, or judgment may be rendered as prayed for therein.
