To: Colony Mortgage Corporation, whose last known place of residence is 1111 Superior Ave, #960, Cleveland, OH 44114 each of you will take notice that on the 29th day of November, 2012, Plaintiff, The Huntington National Bank, filed a Complaint for Foreclosure in the Mahoning County Court of Common Pleas, being Case No. 11CV 3796, alleging that there is due to the Plaintiff the sum of $47,262.11 plus interest at 6.875% per annum from July 1, 2011, plus late charges and attorney fees applicable to the terms of the Promissory Note secured by a Mortgage on the real property which has a street address of 5631 Radcliffe Avenue, Youngstown, OH 44515, being permanent parcel number 48-110-0-101-00-0.
Plaintiff further alleges that by reason of a default in payment of said Promissory Note according to its tenor, the conditions of said Mortgage have been broken and the same has become absolute.
Plaintiff prays that the Defendant named above be required to answer and set forth their interest in said real property or be forever barred from asserting any interest therein, for foreclosure of said mortgage, marshalling of liens, and the sale of said real property, and the proceeds of said sale be applied according to law.
Said Defendant is required to file an Answer on or before the 28th day of August, 2012.
