To: The Unknown Heirs, Devisees, Their Spouses and Creditors, Legatees and the Fiduciary of the Estate and Spouses and Creditors of John Berardi, Jr., AKA John Berardi, whose last known place of residence is: unknown, you will take notice that on the 26th day of April, 2011, Plaintiff, JP Morgan Bank, N.A., successor by merger to Bank One, N.A., filed a Complaint for Foreclosure in the Mahoning County Court of Common Pleas, being Case No. 11CV 1304, alleging that there is due to the Plaintiff the sum of $75,784.79 plus interest at 3.2500% (variable) per annum from June 6, 2008, plus late charges and attorney fees applicable to the terms of the Line of Credit Agreement secured by a Mortgage on the real property, which has a street address of 12114 Blosser Road, North Lima, OH 44452, being permanent parcel number Parcel No. 05-093-0-011.000.
Plaintiff further alleges that by reason of the default in payment of said Line of Credit Agreement, the conditions of said Mortgage have been broken and the same has become absolute.
Plaintiff prays that the Defendants named above be required to answer and assert any interest in said real property or be forever barred from asserting any interest therein, for foreclosure of said mortgage, marshalling of liens, and the sale of said real property, and that the proceeds of said sale be applied according to law.
Said Defendant is required to file an Answer on or before the 22nd day of June, 2011.
