Case No. 10CV 4554
Judge John M. Durkin
PLAINTIFF,
VS.
UNKNOWN HEIRS, ADMINISTRATORS, CREDITORS, EXECUTORS, LEGATEES AND DEVISEES IF ANY OF JOAN P. MOHNEY, DECEASED, ET AL
DEFENDANTS.
Unknown Heirs, Administrators, Creditors, Executors, Legatees and Devisees if any of Joan P. Mohney, deceased, whose last known address is unknown and John Doe, Unknown Spouse if any of Joan P. Mohney, deceased, whose last known address is 36 Benton Street, Youngstown, OH 44515, will take notice that on the 6th day of December, 2010, PNC Bank, N.A., Successor by Merger with National City Bank, filed its Foreclosure Complaint in Case Number 10 CV 4554 in the Mahoning County Common Pleas Court, alleging that Defendants have or claim to have an interest in the real estate commonly known as 36 Benton Street, Youngstown, OH 44515, and also known as Parcel Number 48-027-0-110.00-0 of the Auditor's Records of Mahoning County, Ohio. Said parcel is more particularly described in Exhibit "A" attached to Plaintiff's mortgage recorded in OR Book 5613, Page 768, on the 28th Day of April, 2006 in the Recorder's Office of Mahoning County, Ohio.
The Complaint further alleges that by reason of default of the account of Joan P. Mohney, in the payment of a promissory note according to its tenor, the conditions of a mortgage deed given to it to secure payment of the said note and conveying the premises described therein have been broken and the same has become absolute. The Complaint further prays that the Defendants named above be required to answer and set up their interest in said real estate or be forever barred from asserting the same, for foreclosure of said mortgage, the marshalling of any liens, and the sale of said real estate, and further that the proceeds of said sale be applied to payment of Plaintiff's claim in the proper order of its priority and for such other and further relief as is just and equitable. The Defendants named above are required to answer on or before the twenty-eighth day following the last date of publication, or the 17st day of May, 2011, or a judgment may be rendered as prayed for herein.
