To: Billy K. Tyree, Jr., whose last known place of residence is unknown, The Unknown Heirs, Devisees, their Spouses and Creditors, Legatees, and the Fiduciary of the Estate, and Spouse and Creditors, of Billy K. Tyree, Jr., Deceased, whose last known place of residence is unknown; each of you will take notice that on the 22nd day of February, 2010, Plaintiff, filed a Complaint for Foreclosure in the Mahoning County Court of Common Pleas, being Case No. 10CV 680, alleging that there is due to the Plaintiff the sum of $20,009.55 plus accrued interest of $1,591.86 plus interest at 8.99% per annum from January 8, 2010, plus late charges and attorney fees applicable to the terms of the Promissory Note secured by a Mortgage on the real property, which has a street address of 138 Boardman Boulevard, Youngstown, OH 44512, being permanent parcel number PPN: 29-032-0-027.000.
Plaintiff further alleges that by reason of said Promissory Note, the conditions of said Mortgage have been broken and the same has become absolute.
Plaintiff prays that the Defendants named above be required to answer and assert any interest in said real property or be forever barred from asserting any interest therein, for foreclosure of said mortgage, marshalling of liens, and the sale of said real property, and that the proceeds of said sale be applied according to law.
Said Defendants are required to file an Answer on or before the 13th day of May, 2010.
