Defendants, James Marcum, aka James W. Marcum and Mary Marcum, aka Mary G. Miller, Individually and Surviving Spouse and Beneficiary of James Marcum, aka James W. Marcum, deceased, whose residences are unknown and cannot with reasonable diligence be ascertained; that the names and places of residences of Defendants, The Estate of James Marcum, aka James W. Marcum, deceased; The Unknown Heirs, Next of Kin, Devisees, Legatees, Personal Representatives, and Assigns of James Marcum, aka James W. Marcum, deceased; John Doe, Unknown Spouse, if any, of Mary Marcum, aka Mary G. Miller; and The Unknown Heirs, Next of Kin, Devisees, Legatees, Personal Representatives, Assigns, and Surviving Spounse, if any, of Mary Marcum, aka Mary G Miller, deceased, are unknown and cannot with reasonable diligence be ascertained and upon whom service of summons cannot be had in the State of Ohio will take notice that on the 3rd day of December, 2009, Plaintiff, Tod Kruest filed a Foreclosure Complaint to Transfer and Vest Title in a Tax Certificate Holder pursuant to Revised Code Section 5721.37(F) naming them as Defendants, in the Court of Common Pleas of Mahoning County, Ohio, the same being Case No. 09CV 4579 in said Court, to foreclose the tax lien certificate and the transfer of real estate title. The real estate which is the subject of the within action more fully described in the Notice of Intent to Foreclose and known as:
PERMANENT PARCEL NO. 42-044-0-016.00-0
PROPERTY LOCATION: Oak Street, GL 13.
Plaintiff prays that the Defendants named above be required to answer and set forth their interest in said premises or be forever barred from asserting the same, that Plaintiff's tax lien certificate be found to be a good and valid first lien on said premises, that the equity of redemption of said premises be foreclosed, and that the title to the subject premises be transferred to and vested in Plaintiff.
The persons first above mentioned will take further notice that they have been made party Defendants in said Complaint and that they are required to answer on or before the 23rd day of March, 2010.
