To: Richard K. Emanuel, whose last known place of residence is 10 Crescent Drive, New Cumberland, PA 17070-2701 and 315 Stadium Drive, Youngstown, OH 44512, you will take notice that on the 21st day of May, 2009, Plaintiff, filed a Complaint for Foreclosure in the Mahoning County Court of Common Pleas, being Case No. 2009 CV 1884, alleging that there is due to the Plaintiff the sum of $52,523.81 plus accrued interest of $1,573.20, plus interest at 7.25000% (variable) per annum from April 30, 2009, plus late charges and attorney fees applicable to the terms of the Promissory Note secured by a Mortgage on the real property, which has a street address of 315 Stadium Drive, Youngstown, OH 44512, being permanent parcel number PPN: 29-101-0-017.000.
Plaintiff further alleges that by reason of the default in the payment of said Promissory Note, the conditions of said Mortgage have been broken and the same has become absolute.
Plaintiff prays that the Defendant named above be required to answer and assert any interest in said real property or be forever barred from asserting any interest therein, for foreclosure of said mortgage, marshalling of liens, and the sale of said real property, and that the proceeds of said sale applied according to law.
Said Defendant is required to file and answer on or before the 10th day of November, 2009.
