To: David Peterson, whose last known place of residence is: 2520 Elm Street, Youngstown, OH 44505 and The Unknown Heirs, Devisees, their Spouses and Creditors, Legatees, and the Fiduciary of the Estate, and Spouse and Creditors of David Peterson, Deceased, whose last place of residence is: unknown, each of you will take notice that on the 10th day of July, 2009, Plaintiff, filed a Complaint for foreclosure in the Mahoning County Court of Common Pleas, being Case No. 09CV 2581, alleging that there is due to the Plaintiff the sum of $80,841.25 plus accrued interest of $2,830.32, plus interest at the rate of 8.36500% per annum from January 1, 2009, plus late charges and attorney fees applicable to the terms of the Promissory Note secured by a Mortgage on the real property
Known for street numbering purposes as 2520 Elm Street, Youngstown, OH 44505
PERMANENT PARCEL NO. 53-014-0-025.000
The Plaintiff further alleges that by reason of the default in payment of said Promissory Note, the conditions of said Mortgage have been broken and the same has become absolute.
Plaintiff prays that the Defendants named above be required to answer and assert any interest in said real property or be forever barred from asserting the same, for foreclosure of said mortgage, marshalling of liens, and the sale of said real property, and that the proceeds of said sale be applied according to law.
Said Defendants are required to file an Answer on or before the 10th day of September, 2009.
