UNKNOWN HEIRS OF WILLIAM H. REED, ET AL
DEFENDANTS.
The Defendants, Unknown Heirs of William H. Reed, et al, whose names and addresses are unknown, and cannot with the exercise of reasonable diligence be ascertained and upon whom Service of Summons cannot be had in the State of Ohio will take notice that on 29th day of May, 2009, the Plaintiff, City of Campbell, filed their petition naming them in the Court of Common Pleas of Mahoning County, the same being case number 09CV 2011 in said Court, for the appropriation of real property for highway purposes. The real property which is the subject of the within action more fully described in Plaintiff's petition and known as:
being part of the City of Campbell Outlot Number 1, of the lands conveyed to unknown heirs of William H. Reed, as recorded in Volume 86, Page 163 of the records of the Mahoning County Recorder's Office.
The prayer of the Petition is for authority to appropriate the real property for highway purposes. Plaintiff prays that the Defendants named above be required to answer and set up their interest in said premises or be forever barred from asserting same, and said real property appropriated as provided by law. Pursuant to Civil Rule 12 (A) (1), said persons mentioned above shall take further notice that they have twenty-eight (28) days after the completion of the Service by Publication within which to answer or otherwise defend against Plaintiff's petition.
The original of any such answer or other pleading defending against Plaintiff's petition, must be filed with Anthony Vivo, the Clerk of Common Pleas Court of Mahoning County, Ohio, whose office is located at the Mahoning County Court House, 120 Market Street, Youngstown, Ohio and whose mailing address is 120 Market Street, Youngstown, Ohio 44503-1726. A copy of any such answer or other pleading defending against Plaintiff's petition must be served upon Plaintiff's attorney, to wit: Mark J. Kolmacic, Law Director, City of Campbell, 351 Tenney Avenue, Campbell, Ohio 44405.
A failure to answer or otherwise defend within said twenty-eight (28) days will result in Plaintiff, pursuant to Civil Rule 55, asking the Court to grant a judgment by default against any such person who failes to answer or otherwise defend.
The persons first above mentioned will take further notice that they have been made party Defendants is said petition and that they are required to answer on or before the 21st day of July, 2009.
