To: Robert A. Kane, whose last known places of residences are 445 McDonald Avenue, McDonald, OH 44437 and 50 Weldon Lane, Canfield, OH 44406 you will take notice that on the 14th day of April, 2009, Plaintiff, filed a Complaint for foreclosure in the Mahoning County Court of Common Pleas, being Case No. 2009 CV 1349, alleging that there is due to the Plaintiff the sum of $67,449.42 plus accrued interest of $2,059.85 plus interest at the rate of 6.125% (variable) per annum from April 1, 2009, plus late charges and Attorney fees applicable to the terms of the Promissory Note secured by a Mortgage on the real property, which has a street address of 50 Weldon Lane, Canfield, OH 44406, being permanent parcel number PPN: 28-023-0-018.000
Plaintiff further alleges that by reason of a default in payment of said Promissory Note, the conditions of said Mortgage have been broken and the same has become absolute.
Plaintiff prays that the Defendants named above be required to answer and set forth their interest in said real estate, or be forever barred from asserting the same, for foreclosure of said mortgage, marshalling of liens, and the sale of said real estate, and the proceeds of said sale applied to the payment of Plaintiff‘s claim in the proper order of its priority, and for such other relief as is just and equitable.
Said Defendants named above are required to answer on or before the 22nd day of July, 2009.
