Defendant John Doe, the Unknown Spouse of Michelle M. Smith, whose addresses are unknown, will take notice that on the 14th day of July, 2008, Private Capital Group, LLC, filed its Complaint in Case Number 08CV 2842, in the Court of Common Pleas of Mahoning County, Ohio, alleging that the defendant, the Unknown Spouse of Michelle M. Smith, whose address is unknown, has or may claim to have an interest in the real estate described below:
Situated in the City of Youngstown, County of Mahoning, and State of Ohio: and known and described as follows, to wit:
And known as being Youngstown City Lot No. 32448, according to the latest enumeration of lots in said City, in Plat No. 4 of Cochran Park, as shown by the recorded Plat of said Subdivision in Volume 17 of Maps, Page 81 of Mahoning County Records. Said Youngstown City Lot No. 32448 has a frontage of 41.86 feet on the Southerly side of Auburndale Avenue and extends back 125 feet on the Easterly line, 125 feet on the Westerly line and has a rear line of 41.86 feet, be the same more or less, but subject to all legal highways.

PROPERTY LOCATION: 307 Auburndale Avenue, Youngstown, Ohio 44507.
Plaintiff further alleges that by reason of default in the payment of the promissory note, according to its tenor, the conditions of a concurrent mortgage deed given to secure the payment of said note and conveying the premises described, has been broken and the same has become absolute.
The Plaintiff demands that the defendant named above be required to answer and set up their interest in said real estate or be forever barred from asserting the same, for foreclosure of said mortgage, the marshalling of any liens, and the sale of said real estate, and the proceeds of said sale shall be applied to the payment of Plaintiff's claim in the proper order of its priority and for such other and further relief as is just and equitable.
The Defendants named above are required to answer on or before the 28th day of January, 2009.
