Jeffrey A. Bralich, Unknown Spouse of Jeffrey A. Bralich and Bralich Inc., whose addresses are unknown, are hereby notified that First National Bank of America filed a Complaint in the Common Pleas Court, Mahoning County, Ohio in Case No. 2008 CV 4283 against them, alleging that on the 29th day of December, 2005, Jeffrey A. Bralich, executed to First National Bank of America a promissory note: and that the payments on the note are in default, and there is due Plaintiff thereon the sum of Eighty-eight Thousand One Hundred Thirty-two and 70/100 ($88,132.70) with interest at the rate of 11.95% per annum, from June 1, 2008; that in order to secure the promissory note Jeffrey A. Bralich executed and delivered to First National Bank of America a mortgage deed, and conveyed the following described real estate;

Situated in the City of Youngstown, State of Ohio, and County of Mahoning and described as follows:

Situated in the City of Youngstown, County of Mahoning, State of Ohio, and known as being a part of Youngstown City Lot No. 334 in the Replat of Youngstown City Lot No.'s 330, 334 and 335 as found recorded in the Mahoning County Records of Plats Volume 109, at Page 224, and being further bounded and described as follows:

Commencing at a point on the northerly right-of-way line of West Federal Plaza; Thence North 32 Degrees 04' 15" East a distance of 161.00 Feet to a 5/8 Iron Pin Set: Thence South 58 Degrees 00' 00" East a distance of 50.23 Feet to a 5/8" Iron Pin Set on the Westerly Line of a 15 Foot Alley: Thence South 31 Degrees 58' 30" West along the Westerly Line of Said Alley a distance of 31.00 Feet to a 5/8" Iron Pin Set: thence North 58 Degrees 00' 00" West continuing along said Alley a distance of 9.50 Feet to a Point Lot; Thence South 31 Degrees 58' 30" West a distance of 130.00 Feet to a Point on said Northerly Line of West Federal Plaza; thence North 58 Degrees 00' 00" West along said West Federal Plaza a distance of 41.00 Feet to the true Point of Beginning, and Continuing 0.1578 Acres of Land, More or Less. As Shown on Said Replat.

PROPERTY LOCATION: 116 Federal Plaza West, Youngstown, Ohio 44503.

Plaintiff says that said mortgage was delivered to the Recorder of Mahoning County, Ohio on the 4th day of January, 2006 and was recorded in Official Record 5588, Page 1053, Recorder's Office, Mahoning County, Ohio and is the first and best lien on said premises save the lien of taxes and assessments and the costs of this action.

That by reason of the failure to make the monthly payments as required, the Plaintiff has declared the entire amount due and mortgage securing such note to be absolute; that the Treasurer of Mahoning County, Ohio; may have a claim against said premises. Therefore, Plaintiff prays for a judgment in the amount of Eighty-eight Thousand One Hundred Thirty-two and 70/100 ($88,132.70) with interest at the rate of 11.95% per annum, from June 1, 2008, plus late charges, advances and penalties; that the mortgage be foreclosed and all equities of redemption be forever cut off; that the Plaintiff be found to have the first and best lien therein; that the priority of all liens be determined by this Court; that said premises be sold as upon execution free and clear of all liens, interest and dower and the proceeds thereof applied to the Plaintiff's claims; and that Plaintiff may have such other and further relief to which it may be entitled at law or in equity.

Defendants first hereinabove named are further notified that they are required to answer said Complaint on or before the 20th day of March, 2009 which includes 28 days from the last publication, or judgment may be rendered as prayed for therein.
