Richard Beight, whose last known address is: 84 North Turner Road, Youngstown, Ohio 44515 otherwise whose address is unknown, will hereby take notice that on the 8th day of February, 2008, Harry Horton, et al, filed a Complaint against you in the Court of Common Pleas of Mahoning County, Ohio, being Case Number 08CV 587 on the docket of said Court, alleging that

On or about February 10, 2006, the Plaintiff, Harry Horton, was operating his motor vehicle traveling on Raccoon Road, City of Canfield, County of Mahoning, State of Ohio.

At said time and place, Defendant, Richard Beight was also traveling on Raccoon Road directly behind Plaintiff's vehicle, failed to follow at an assured clear distance and negligently rear-ended Plaintiff's vehicle.

As a direct and proximate result of the Defendant's negligence and as a direct and proximate result of said collision as described, Plaintiff suffered physical pain and emotional distress thereby undermining his health and well-being. Furthermore, Plaintiff has suffered pain and will, with reasonable certainty, continue to so suffer in the indefinite future. As a dirct and proximate result of the Defendant's negligence, Plaintiff was required to obtain medical care for his injuries and to expend sums of money, and he will with reasonable certainty, continue to require further medical care and treatment and pay additional sums therefore in the definite future.

Wherefore, Plaintiffs demand judgment against the Defendant, in an amount of Forty-Five Thousand Dollars ($45,000.00). Additionally, Plaintiffs demand interest, costs incurred herein and any and all other just and equitable relief to which the Plaintiffs are entitled.

You are required to answer the Complaint within Twenty-eight (28) days from the last date of publication of this notice, which will be published for six (6) successive weeks, said answer day being the 26th day of November, 2008.
