Davis, whose last known place of residence is: unknown, each of you will take notice that on the 9th day of April, 2008, the undersigned, Plaintiff, filed a Complaint for Money, Foreclosure, and Other Equitable Relief in the Mahoning County Court of Common Pleas Case Number being 2008CV01469, alleging that there is due to the Plaintiff the sum of $17,886.43 plus interest at the rate of 8.1250% (variable) per annum from February 1, 2008, plus late charges applicable to the terms of the Note and Mortgage, on a Promissory Note secured by a Mortgage Deed of even date conveying the following-described property, to-wit:

And known as and being Lot Nos. 33, 34 and 35 in the Thelma City Plat of lots as the same are marked, numbered and distinguished on the recorded plat on file in the County Recorder's Office in Youngstown, Ohio.

Situated in the Township of Smith, County of Mahoning and State of Ohio:

And known as being a part of a strip or parcel of land situated in the Northeast corner of Section No. 32, Smith Township, Mahoning County, State of Ohio, and more particularly described as follows:

Beginning at a point at the Southwest corner of Lot No. 33 in Thelma City Allotment, Smith Township, Mahoning County, Ohio;

Thence South 8 feet to a point on the Northern line of what was formerly known as the Stark Electric R.R. Co. right-of-way, as the true place of beginning;

Thence South 50 feet to a point on the South line of the Stark Electric R.R. Co. right-of-way;

Thence South 8 feet to a point on the Northern line of what was formerly known as the Stark Electric R.R. Company right-of-way as the true place of beginning;

Thence South 50 feet to a point on the South line of the Stark Electric R.R. Company right-of-way;

Thence East 80 feet to a point on the South line of the Stark Electric R.R. Co. right-of-way;

Thence North 50 feet to a point on the Northern line of the Stark Electric R.R. Co. right-of-way and being 8 feet South of the Southeast corner of Lot No. 37;

Thence North 50 feet to a point 6 feet from the Southeast corner of Lot 39 in said Thelma City Allotment;

Thence West and parallel to the South lot lines of Lot Nos. 38 and 39 in said Thelma City Allotment, 80 feet to the place of beginning.

The Plaintiff further alleges that by reason of the default of the Defendants obligors in the payment of said note according to its tenor, the conditions of said Mortgage Deed have been broken and the same has become absolute.

Plaintiff prays that the Defendants named above be required to answer and set forth any interest in said real estate, or be forever barred from asserting the same, for foreclosure of said mortgage, marshalling of liens, and the sale of said real estate, and the proceeds of said sale applied to the payment of Plaintiff's claim in the proper order of its priority, and for such other relief as is just and equitable.

The Defendants named above are required to answer on or before the 29th day of July, 2008.
