The Unknown Heirs, Devisees, Legatees, Administrators, Executors, and Assigns of Johnell Cathey, Deceased, whose last place and present place of residence is unknown, will take notice that on the 6th day of August, 2007, Wells Fargo Bank, NA, as Trustee for Option One Mortgage Loan Trust 2002-3 Asset-Backed Certificates, Series 2002-3, filed its Complaint in Case No. 07CV 2856 in the Court of Common Pleas, Mahoning County, Ohio, alleging that the Defendants, The Unknown Heirs, Devisees, Legatees, Administrators, Executors, and Assigns of Johnell Cathey, Deceased, have or claim to have an interest in the real estate described below:
Situtated in the City of Youngstown, County of Mahoning and State of Ohio, and bounded and described as follows to wit:
And known as being the easterly part of Youngstown City Lot Number Thirty-four Thousand Four Hundred Eight (34408) according to the latest enumeration of lots in said City as recorded in Volume 19 of Plats, Page 12, Mahoning County Records, and is bounded and described as follows:
Beginning at the point where the north line of Cohasset Drive intersects the southwest corner of City Lot No. 34407; thence north along the west line of City Lot No. 34407, a distance of One Hundred (100) feet to the northwest corner of said lot; thence west along the rear line of City Lot No. 34408, Thirty-five and Five-tenths (35.5) feet to a point on the east line of land now or formerly owned by Ruth H. Mobley; thence southerly along the east line of said Mobley lands approximately Ninety-nine and Nine tenths (99.9) feet to the southeast corner of City Lot No. 34409; thence east along the north line of Cohasset Drive, Forty (40) feet to the place of beginning, be the same more or less.

The Petitioner further alleges that by reason of default of the Defendant(s) in the payment of a promissory note, according to its tenor, the conditions of a concurrent mortgage deed given to secure the payment of said note and conveying the premises described, have been broken, and the same has become absolute.
The Petitioner prays that the Defendant(s) named above be required to answer and set up their interest in said real estate or be forever barred from asserting the same, for foreclosure of said mortgage, the marshalling of any liens, and the sale of said real estate, and the proceeds of said sale applied to the payment of Petitioner‘s claim in the proper order of its priority, and for such other and further relief as is just and equitable. THE DEFENDANT(S) NAMED ABOVE ARE REQUIRED TO ANSWER ON OR BEFORE THE 14th DAY OF DECEMBER, 2007.
