Case No. 07CV 1911

JP MORGAN CHASE BANK, NA, SUCCESSOR BY MERGER WITH BANK ONE, NA

PLAINTIFF,

VS.

ESTATE OF EARL A. WINNER, ET AL

DEFENDANTS.

Jane Doe, Unknown Spouse, if any, of Earl A. Winner, whose last known address is 42 Fairlawn, Boardman, Ohio 44512, will hereby take notice that on the 29th day of May, 2007, JP Morgan Chase Bank, NA, Successor by merger with Bank One, NA, filed its Complaint in Case Number 07CV 1911 in the Court of Common Pleas of Mahoning County, Ohio, alleging that Defendants have or claim to have an interest in the real estate commonly known as 4646 Norquest Blvd., Youngstown, OH 44515, and also known as Parcel Number 48-026-0-142.00-0 of the Auditor's Records of Mahoning County, Ohio. Said parcel is more particularly described in Exhibit "A" attached to Plaintiff's Mortgage filed in Official Record Book, 5255, Page 2439 on the 10th day of October, 2002 in the Recorder's Office of Mahoning County, Ohio.

The Complaint further alleges that by reason of default of the Defendant, Estate of Earl A. Winner, in the payment of a promissory note according to its tenor, the conditions of a mortgage deed given to it to secure payment of the said note and conveying the premises described therein have been broken and the same has become absolute. The Complaint further prays that the Defendants named above be required to answer and set up their interest in said real estate or be forever barred from asserting the same, for foreclosure of said mortgage, the marshalling of any liens, and the sale of said real estate, and further that the proceeds of said sale be applied to payment of JP Morgan Chase Bank, N.A., successor by merger with Bank One, N.A.'s claim in the proper order of its priority and for such other and further relief as is just and equitable. The Defendants named above are required to answer on or before the 19th day of December, 2007, or a judgment may be rendered as prayed for herein.
