DEFENDANTS.

Defendant, Daniel Duran, Jr., whose place of residence is unknown and whose last known address is 53 Water Street, Poland, Ohio 44514, and who cannot be served within the State of Ohio, will take notice that on the 6th day of August, 2007, Countrywide Bank, FSB, filed a Complaint as Plaintiff in the Court of Common Pleas of Mahoning County, Ohio, in Case Number 07CV 2854 against Daniel Duran, Jr., and others as Defendants, alleging that Defendant, Daniel Duran, Jr., executed and delivered a certain Note, a copy of which is attached to the Complaint and made a part thereof, that there is due to Plaintiff from Defendant, Daniel Duran, Jr., by reason of default under the terms of the Note the unpaid principal balance of $165,375.52 plus interest at the rate of 7.125% per annum from April 1, 2007; that to secure the payment of said Note Defendants, Daniel Duran, Jr. and Renee A. Duran, aka Renee Duran, executed and delivered a Mortgage deed, thereby conveying the following described premises:

The land referred to in this commitment, situated in the Village of Poland, County of Mahoning, State of Ohio, is described as follows:

Known as being Lot No. 956 in the replat of P.V.L. Nos. 954 and 956 as recorded in Volume 92, Page 30 of the Mahoning County Record of Plats and being furhter described as follows:

Said Lot No. 956 has a combined frontage of 92.12 feet on the Northwesterly right of way line of Water Street, a Northeasterly line of 121.86 feet, Southwesterly line of 131.25 feet, a rear line of 79.73 feet and contains within said bounds 0.255 acres of land as appears by said plat.

that said Note is in default, whereby the conditions set forth in said Note and Mortgage have been broken, said Mortgage Deed has become absolute and Plaintiff is entitled to have said Mortgage foreclosed, said premises sold, and the proceeds applied in payment of Plaintiff's claims; that Defendants, Mahoning County Treasurer, Unknown Tenant, Mortgage Electronic Registration Systems, Inc., as nominee for Countrywide Bank, a Division of Treasury Bank, N.A., and the Clerk of Courts, may have or claim to have some interest in or lien upon said premises; that all of said Defendants be required to set forth any claim, lien or interest in or upon the above described premises wheich he or she may have or be forever barred there from; that therefore Plainfiff demands judgment against the Defendant, Daniel Duran, Jr., in the amount of $165,375.52 plus interest at the rate of 7.125% per annum from April 1, 2007, plus any sums advanced to pay real estate taxes, hazard insurance premiums, property protection and maintenance, plus late charges and interest from the date of such advances; for Plaintiff's cost of evidence of title and for all of its costs herein expended; that the Mortgage referred to be found and adjudged to be a valid and subsisting, first and best lien upon the real estate described herein; that the Mortgage and the Defendants equity of redemption be foreclosed; that all parties hereto answer as to their interests or be forever barred from asserting the same; that all liens be marshakled and their priorities determined; that the premises be sold as if upon execution, and the proceeds of any sale be applied according to law; and for such other relief as is just and equitable.

Defendant, Daniel Duran Jr., is further notified that he is required to answer said Complaint on or before 28 days after the last week that the publication has run for six successive weeks, said answer day being the 14th day of December, 2007 or Judgment may be rendered as prayed for therein.
