DEFENDANTS.

Defendant, David A. Nolfi, dba Stateline Plumbing & Heating, whose last known place of residence and Post Office address was 59 Ward Avenue, New Middletown, Ohio 44442, but whose present residence and residence address is unknown and cannot without resonable diligence be ascertained:

Defendant, Sky Bank, has brought action naming you as a defendant in the Court of Common Pleas of Mahoning County, Ohio, being Case Number 07CV 810 on the docket of said Court by filing its Answer and Cross Claim on the 12th day of April, 2007.

The object of the Answer and Cross Claim of Defendant, Sky Bank, is to foreclose the equity of redemption under a mortgage against the following described real estate:

Situated in the Village of New Middletown, County of Mahoning and State of Ohio and known as being Lot Number 234 according to the latest enumeration of lots in said Village formerly known as Sublot No. 32 in Middletown Height Plat No. 3, as recorded in Volume 36 of Plats, Page 113, Mahoning County Records. Said lot has a frontage of 100 feet on the north line of Ward Avenue and extends back on its east line 200 feet, and on its west line 200 feet, having a rear line of 100 feet, as appears by said plat, subject to all legal highways.

PERMANENT PARCEL NO.: 03-002-0-080.000

PROPERTY LOCATION: 59 Ward Avenue, New Middletown, OH 44442.

And for judgment upon a Home Equity Line of Credit Account Agreement executed to Defendant, Sky Bank, by Defendant, David A. Nolfi.

The relief demanded is a judgment against the Defendant, David A. Nolfi, in the amount of $58,741.72, along with interest at the rate of $24.14 per day from December 23, 2006, until paid, and for Court costs; that said mortgage may be foreclosed and the said real estate described herein be sold at Sheriff's Sale and the proceeds of said sale applied for payment of Defendant's claim; further that Defendant, David A. Nolfi, dba Stateline Plumbing and Heating, be required to answer setting forth their claim or interest in the subject real estate, if any, or forever be barred from claiming or asserting same; and for such other and further relief to which Plaintiff may be entitled.

You are required to answer the Complaint within Twenty-eight (28) days from the last date of publication of this notice, which will be published for six (6) successive weeks, said answer day being the 31st day of August, 2007.

In case of your failure to answer or otherwise respond as required by the Ohio Rules of Civil Procedure, judgment by default will be rendered against you for the relief demanded in the Complaint.
