Defendants, Helen M. Bayus and John Doe, Real name unknown, the unknown spouse if any, of, Helen M. Bayus, whose last known addresses are 36 Lucerne Lane, Youngstown, Ohio 44511 and 196 Struthers Liberty Road, Campbell, Ohio 44405, and the Unknown Heirs, Devisees, Legatees, Administrators, and Assigns of Helen M. Bayus, Deceased, whose Identities and Addresses are unknown, will take notice that on the 28th day of September, 2006, Sky Bank, filed its Complaint in Case Number 06CV 3794, in the Court of Common Pleas of Mahoning County, Ohio, alleging that the defendants, Helen M. Bayus and John Doe, Real Name Unknown, The Unknown Spouse, if any, of Helen M. Bayus, and the Unknown Heirs, Devisees, Legatees, Administrators, and Assigns of Helen M. Bayus, Deceased, have or claim to have an interest in the real estate described below:
Situated in the Township of Boardman, County of Mahoning, State of Ohio:
Known as Sub Lot No. 25 in Hopkins Heights Plat No. 1, subdivision of a part of Boardman Township Great Lots 1 and 2 of the Fourth Division as shown by the recorded plat of said Subdivision in Volume 40 of Maps, Pages 2 and 3 of Mahoning County Records and being 61.0 feet front on the northwesterly side of Lucerne Lane and extending back of equal width 150 feet, as appears by said plat.
Known for street numbering purposes as 36 Lucerne Lane, Youngstown, OH 44511
PERMANENT PARCEL NO. 29-084-0-168.000
The Plaintiff further alleges that by reason of default in the payment of the promissory note, according to its tenor, the conditions of a concurrent mortgage deed given to secure the payment of said note and conveying the premises described, have been broken and the same has become absolute.
The Plaintiff demands that the defendants named above be required to answer and set up their interest in said real estate or be forever barred from asserting the same, for foreclosure of said mortgage, the marshalling of any liens, and the sale of said real estate, and the proceeds of said sale applied to the payment of Plaintiff‘s claim in the proper order of its priority and for such other and further relief as is just and equitable.
The defendants named above are required to answer on or before the 15th day of February, 2007.
