ARTHUR L. DERHODES, ET AL

DEFENDANTS.

The Unknown Heirs of Arthur De Rhodes, aka Arthur L. DeRhodes, whose last known address is Unknown, otherwise whose place of residence is unknown and cannot by reasonable diligence be ascertained, will take notice that on the 5th day of June, 2006, The CIT Group/Consumer Finance, Inc and Mortgage Electronic Registration System, Inc., as nominee for the CIT Group/Consumer Finance, Inc., filed their Petition against them in the Court of Common Pleas of Mahoning County, Ohio, being Case Number 06CV 2117 in said Court, alleging that there is due the Plaintff the sum of $106,640.06 with interest at 6.50% per annum from October 1, 2005 plus any sums advanced on a note secured by a mortgage deed of even date conveying the following described property, to wit:

Situated in the Township of Springfield, County of Mahoning and State of Ohio: And known as being Lot No. 15, as shown in a plat thereof known as a replat of Clyde E. DeRhodes Plat 2, Section 4 recorded in Volume 57, Page 350 of Mahoning County Records of Plats.

PROPERTY LOCATION: 3936 East Calla Road, Poland, OH 44514.

The Complaint further alleges that by reason of the default of the Defendant obligor in the payment of said note according to its tenor, the conditions of said mortgage deed have been broken and the same has become absolute. Plaintiffs pray that the Defendants named above be required to answer and set up their interest in said real estate, or be forever barred from asserting the same, for foreclosure of mortgage, marshalling of liens and sale of said real estate, and the proceeds of said sale applied to the payment of Plaintiffs' claim in the proper order of its priority, and for such other and further relief as is just and equitable.

You are required to answer the Complaint within Twenty-eight (28) days from the last date of publication of this notice, which will be published once a week for six (6) successive weeks, said answer day being the 1st day of February, 2007.

In case of your failure to answer or otherwise respond as required by the Ohio Rules of Civil Procedure, judgment by default will be rendered against you for the relief demanded in the Complaint.
