Timothy George, Bernice Elliot, aka Bernice George, and Unknown Tenant or Land Contract Vendee, whose exact address cannot be ascertained with reasonable diligence shall take notice that on the 18th day of January, 2006, Plaintiff, American Tax Funding, LLC filed its Complaint in Foreclosure Case No. 06CV 205 in the Court of Common Pleas, Mahoning County, Ohio, to foreclose the liens held by it for delinquent real estate taxes, assessments, penalties, interest, charges, and costs with respect to the real property located at:

In the County of Mahoning, State of Ohio, known as being Lot 46 in the Town of New Albany and a fractional lot in said Town of New Albany; said fractional lot is bounded on the East by Main Street; South by lands formerly owned by Sebasten Redinger; West by lands formerly owned by Charles Getz; and North by the aforesaid Lot No. 46.

Said fractional Lot in the Village of New Albany also being described as follows:

Situated in the Township of Green, County of Mahoning and State of Ohio, and being part of Section 20 of said Township, and being more particularly bounded and described as follows:

Beginning at a point on the Westerly line of Main Street in the Village of New Albany at the point of intersection thereof with the Northerly line of a .50 acre parcel of land now or formerly owned by M.B. Black; thence Westerly along said Northerly line of Black's land 100 feet to the point of intersection thereof with the Easterly line of 1.92 acre parcel now or formerly owned by Rema Becck's land 53.38 feet to the point of intersection thereof with the Southerly line of Lot No. 46 in the New Albany Town Plat Addition, recorded in transcribed plat recorded at Pages 14 and 15; thence Easterly along said Southerly line of Lot No. 46, 100 feet to the point of intersection, thereof with the Westerly line of Main Street; thence Southerly along the Westerly line of Main Street 53.38 feet to the place of beginning, be the same more or less, but subject to all legal highways.

The prayer of the Complaint is for an order directing that the above-described property be sold at public auction, that the proceeds therefrom be used to satisfy Plaintiff's liens, and for such other relief as the Court may deem just, equitable, and necessary. Plaintiff further prays that the above-named Defendants be required to answer and set up their interest in said premises or be forever barred from asserting the same, that Plaintiff's liens be found to be good and valid first liens on said premises, and that equity of redemption of said premises be foreclosed.

Said Defendants are required to answer Plaintiff's Complaint within twenty-eight (28) days after the last date of publication of this notice, which notice shall be made once per week for three consecutive weeks, said answer day being the 4th day of April, 2006. If said Defendants fail to timely respond, the Court may enter a default judgment against them for the relief requested in the Complaint.
