Defendants, Doris Wagner and Larry Wagner, whose last known address IS 265 Maplewood Drive, Struthers, Ohio 44471, will take notice that on the 26th day of October, 2005, Wells Fargo Bank, NA, successor by merger with Wells Fargo Home Mortgage, Inc., filed its Complaint in Case Number 05CV 3962, in the Court of Common Pleas of Mahoning County, Ohio, alleging that the defendants, Doris Wagner and Larry Wagner have or claim to have an interest in the real estate described below:

Situated in the City of Struthers, County of Mahoning and State of Ohio and known as being Lot No. 2176 according to the latest enumeration of lots in said City as recorded in Volume 17 of Plats, Page 29, Mahoning County Records. Said Lot has a frontage of 40 feet on the North line of Maplewood Avenue and extends back on its East line 150 feet and on its West line 150 feet, having a rear line of 40 feet as appears by said Plat, be the same more or less, but subject to all legal highways.

Known for street numbering purposes as 265 Maplewood Drive, Struthers, Ohio 44471

PERMANENT PARCEL NO. 38-017-0-068.00-0

The Plaintiff further alleges that by reason of default in the payment of the promissory note, according to its tenor, the conditions of a concurrent mortgage deed given to secure the payment of said note and conveying the premises described, have been broken and the same has become absolute.

The Plaintiff demands that the defendants named above be required to answer and set up their interest in said real estate or be forever barred from asserting the same, for foreclosure of said mortgage, the marshalling of any liens, and the sale of said real estate, and the proceeds of said sale applied to the payment of Plaintiff‘s claim in the proper order of its priority and for such other and further relief as is just and equitable.

The defendants named above are required to answer on or before the 6th day of April, 2006.
