DEFENDANTS.

Unknown Spouse, Heirs, Creditors, Executors, Administrators, Legatees and Devisees, if any, of Eleanor Lynn, deceased, whose last known address is unknown, will take notice that on the 22nd day of August, 2005, J.P. Morgan Chase Bank, N.A., successor by merger with Bank One, N.A., filed a Complaint in Case Number 05CV 3072 in the Court of Common Pleas of Mahoning County, Ohio, on the docket of said Court, alleging that Defendants have or claim to have an interest in the real estate commonly known as:

PERMANENT PARCEL NOS.: 53-180-0-105.00-0, 53-180-0-106.00-0, 53-180-0-107.00-0

PROPERTY LOCATION: 2455 Russell, Youngstown, Ohio 44509.

Said parcel is more particularly described in Exhibit "A" attached to Plaintiff's mortgage filed in official record book, 2245, Page 170 on the 9th day of May, 1994 in the Recorder's Office of Mahoning County Ohio.

PARCEL NO. 1:

Situated in the City of Youngstown, County of Mahoning and State of Ohio:

And known as being Youngstown City Lot No. 21504 according to the latest enumeration of lots in said City, formerly Plat Lot No. 176 in the Kinder Smith Land Company 4 Plat, subdivision of Great Lot No. 12 of Youngstown Township, as shown by the recorded plat of said Subdivision in Volume 12 of Maps, Page 194, of Mahoning County Records. Said City Lot No. 21504 has a frontage of 50 feet on the South line of Russell Avenue and extends back between parallel lines, a distance of 125 feet, being 50 feet in the rear, as appears by said Plat, be the same more or less, but subject to all legal highways and restriction of record.

(Said City Lot Nos. 21499 and 21504 are contiguous)

PARCEL NO. 2:

Situated in the City of Youngstown, County of Mahoning and State of Ohio:

And known as City Lot Number 21505 and 21510 as lots are now numbered in said City. Said City Lots 21505 and 21510 taken together form a compact tract of land having a frontage of Eighty-one and Twenty-eight Hundredths (81.28) feet on the South line of Russell Avenue and extends back, of even width about One Hundred Twenty-five (125) feet, be the same more or less, but subject to all legal highways.

The Complaint further alleges that by reason of default of the Defendants Unknown Spouse, Heirs, Creditors, Executors, Administrators, Legatees and Devisees, if any, of Eleanor Lynn, deceased, in the payment of a promissory note according to its tenor, the conditions of a mortgage deed given to it to secure payment of the said note and conveying the premises described therein have been broken and the same has become absolute.

The Complaint further prays that the Defendants named above be required to answer and set up their interest in said real estate or be forever barred from asserting the same, for foreclosure of said mortgage, the marshaling of any liens, and the sale of said real estate, and further that the proceeds of said sale be applied to payment of J.P. Morgan Chase Bank, N.A., successor by merger with Bank One, N.A.'s claim in the proper order of its priority and for such other and further relief as is just and equitable. The Defendants named upon are required to answer within Twenty-eight (28) days from the last date of publication of this notice, which will be published for six (6) successive weeks, said answer day being the 3rd day of January, 2006, or a judgment may be rendered as prayed for herein.
