The Defendant, TIMOTHY PHILLIPS, whose last claimed address is 1610 Lansdowne Blvd., Youngstown, Ohio 44505 and whose actual last known address and present address are otherwise unknown, and cannot with the exercise of reasonable diligence be ascertained, will hereby take notice that on the 1st day of April, 2005, Plaintiff Holly Kimmel, filed a Complaint in tort designated against you in the Court of Common Pleas of Mahoning County, Ohio, being Case Number 05CV 1211, alleging that

On or about April 4, 2003, Plaintiff was operating a motor vehicle in Youngstown, Ohio and was stopped at a traffic signal at the intersection of Market Street and East Warren Avenue. At that same time and place Defendant was operating a motor vehicle Northbound on Market Street in a negligent fashion, and caused a collison into the rear of the vehicle driven by Plaintiff. As a result of Defendant's negligence Plaintiff suffered sustained temporary and permanent injuries of a physical and pecuniary nature, including, but not limited to pain and suffering, medical expenses, physical and emotional trauma.

The prayer of the complaint is for judgment against the Defendant in the amount in excess of $25,000 in accordance with the Ohio Rules of Civil Procedure.

You are required to answer the Complaint within Twenty-eight (28) days from the last date of publication of this notice, which will be published for six (6) successive weeks, said answer day being the 15th day of December, 2005.

In case of your failure to answer or otherwise respond as required by the Ohio Rules of Civil Procedure, judgment by default will be rendered against you for the relief demanded in the Complaint.
