Unknown heirs and their spouses, the devisees, legatees, executors, administrators and assigns of Diane L. Marsh, and the unknown guardians of minor and/or incompetent heirs of Diane L. Marsh, all of whose addresses are unknown, will take notice that on the 8th day of August, 2005, NovaStar Mortgage, Inc., filed its Complaint in the Court of Common Pleas, Mahoning County, Ohio, Case Number 05CV 2871. The object of, and demand for relief in, the Complaint is to foreclose the lien of plaintiff's mortgage recorded upon the real estate described below and in which plaintiff alleges that the foregoing defendant has or claims to have an interest:

Situated in the Township of Austintown, County of Mahoning and State of Ohio, and known as being Sub Lot No. 39 in Security Gardens Plat No. 2, a subdivision of a part of original Austintown Township Great Lot No. 10, as shown by the recorded plat of said Subdivision in Volume 28 of Maps, Page 39 of Mahoning County Records.

Said Sub Lot No. 39 has a frontage of 90 feet on the Westerly side of Benton Avenue and extends back between parallel lines 150 feet on the Northerly line, 150 feet on the Southerly line and has a rear line of 90 feet as appears by said Plat, be the same more or less, but subject to all legal highways.

PROPERTY LOCATION: 126 Benton Street, Austintown, Ohio 44515.

The defendants named above are required to answer the Complaint within Twenty-eight (28) days after the last date of publication of this legal notice. This legal notice will be published once a week for six (6) successive weeks, said answer day being the 22nd day of November, 2005.
