David Polosky and Unknown Spouse of David Polosky, if any, whose exact address cannot be ascertained with reasonable diligence, shall take notice that on the 10th day of June, 2005, Plaintiff, American Tax Funding, LLC filed its Complaint in Foreclosure Case No. 05CV 2041 in the Court of Common Pleas, Mahoning County, Ohio, to foreclose the liens held by it for delinquent real estate taxes, assessments, penalties, interest, charges, and costs with respect to the real property located at:
Situated in the Township of Milton, County of Mahoning and State of Ohio, and known as being a part of Great Lot No. 18, of the North Survey of Milton Township, and further bounded and described as follows:
Beginning at a point in the centerline of the Youngstown-Akron Road, at the intersection thereof with the Easterly line of a .998 acre parcel of land now or formerly owned by E.C. Porter as shown in deed recorded in Volume 579 of Deeds at Page 259 of Mahoning County Records; thence North 89¼ 47' 12" East along said centerline of the Youngstown-Akron Road for a distance of 100 feet to a point; thence North 0¼ 28' 53" West for a distance of 1,555.14 feet to a point on the Southerly line of State of Ohio public highway lands; thence South 70¼ 20' 44" West along said Southerly line of State of Ohio lands for a distance of 61.02 feet to a point; thence South 51¼ 55" West along said Southerly line of State of Ohio lands for a distance of 354.98 feet to a point; thence South 0¼ 29' East for a distance of 722.06 feet to a point; thence South 89¼ 31' West for a distance of 200 feet to a point on the Easterly line of State of Ohio Public Highway lands; thence South 0¼ 37' 22" West along said Easterly line of State of Ohio lands; for a distance of 253.23 feet to a point on the Northerly line of a 2.5 acre parcel of land now or formerly owned by R.E. Hugli, as shown by deed recorded in Volume 335 of Deeds at Page 34 of Mahoning County Records; thence Easterly along said Northerly line of Hugli lands for a distance of 29.90 feet to the Southeasterly corner of a parcel of land now or formerly owned by E.C. Porter, as shown by deed recorded in Volume 801 of Deeds at Page 49 of Mahoning County Records; thence Northerly along the Westerly line of said E.C. Porter land for a distance of 3 feet to the Northwesterly corner of said E.C. Porter land; thence Easterly along the Northerly line of said E.C. Porter land for a distance of about 108 feet to the Northwesterly corner of land now or formerly owned by Donald Porter, as shown by deed recorded in Volume 801 of Deeds at Page 45; thence Easterly along the Northerly line of said Donald Porter land for a distance of about 108 feet to the Northwesterly corner of land now or formerly owned by R. and R.L. Bungard, as shown by deed recorded in Volume 801 of Deeds at Page 47; thence Easterly along the Northerly line of said Bungard land for a distance of about 107 feet to the Northwesterly corner of land now or formerly owned by E. C. Porter, as shown by deed recorded in Volume 801 of Deeds at Page 49; thence Easterly along the Northerly line of said E.C. Porter land; thence S. 0¼ 28' 53" East along the Easterly line of said E.C. Porter land and continuing along the Easterly line of a .998 acre parcel of land now or formerly owned by E.C. Porter, as shown by deed recorded in Volume 579 of Deeds at Page 259 of Mahoning County Records, for a distance of 442 feet to a point in the centerline of the Youngstown-Akron Road, the place of beginning, and containing within said bounds 9.934 acres, be the same more or less, but subject to all legal highways. According to a survey by M.A. Tuta, Registered Engineer No. 8195, dated February, 1965.

The prayer of the Complaint is for an order directing that the above-described property be sold at public auction, that the proceeds therefrom be used to satisfy Plaintiff's liens, and for such other relief as the Court may deem just, equitable, and necessary. Plaintiff further prays that the above-named Defendants be required to answer and set up their interest in said premises or be forever barred from asserting the same, that Plaintiff's liens be found to be good and valid first liens on siad premises, and that equity of redemption of said premises be foreclosed.
Said Defendants are required to answer Plaintiff's Complaint within twenty-eight (28) days after last date of publication of this notice, which notice shall be made once per week for three consecutive weeks, said answer day being the 15th day of September, 2005. If said Defendants fail to timely respond, the Court may enter a default judgment against them for the relief requested in the Complaint.
