DEFENDANTS.

Mary Jane Burney, and if deceased, all heirs, devisees, legatees, executors, executrixes, administrators, administratrixes and assignees whose address is unknown, will hereby take notice that on the 10th day of September, 2004, Citicorp Trust Bank, filed its Complaint in Foreclosure and Marshalling of Liens in the Court of Common Pleas of Mahoning County, Ohio, being Case Number 04CV 3192 against praying for judgment in the amount of $40,092.62 with interest thereon according to the terms of the note from August 11, 2004 until paid and for foreclosure of said Mortgage Deed on the following described real estate, of which said Defendant, Ruby P. Penson was then and her estate is now the owners of:

Situated in the City of Struthers, County of Mahoning and State of Ohio and bounded and described as follows:

And known as being the South part of Struthers City Lot No. 1104 and all of Struthers City Lot No. 1105, formerly known as Sublot Nos. 782 and 781 in Alteration and 5th Addition to the Village of Struthers, as shown by the Recorded Plat in Volume 9, Page 47 of Mahoning County Records, and together forming a parcel of land 75 feet front on the Easterly side of Narcissa Street, and extending back 134.54 feet on the Northerly line, 134.5 feet on the Southerly line and having a rear line of 75 feet, as appears by said Plat be the same more or less, but subject to all legal highways.

PROPERTY LOCATION: 90 North Narcissa, Struthers, Ohio 44471.

And that Defendant, Mary Jane Burney, and if deceased, all heirs, devisees, legatees, executors, executrixes, administrators, administratrixes and assignees be required to set up any interest they may have in said premises or be forever barred, that upon failure of said Defendant to pay or to cause to be paid said judgment within three days from its rendition that an Order of Sale be issued to the Sheriff of Mahoning County, Ohio, to appraise, advertise in the Daily Legal News and sell said real estate, that the premises be sold free and clear of all claims, liens and interest of any of the parties herein, that the proceeds from the sale of said premises be applied to the Plaintiff's judgment and for such other relief to which Citicorp Trust Bank is entitled.

Said Defendants are directed to the Complaint wherein notice under the fair debt collection practice act is given.

Said Defendants will take notice that it be required to answer said Complaint within Twenty-eight (28) days from the last date of publication of this notice, which will be published for six (6) successive weeks, said answer day being the 9th day of August, 2005, or judgment will be rendered accordingly.
