DEFENDANTS.

Defendants, Frederick W. Hartman and Francis Hartman, whose last known place of residence was 324 Elm Street, Struthers, Ohio 44471, and who cannot be served within the State of Ohio, will take notice that on the 2nd day of March, 2005, Wells Fargo Bank Minnesota, filed a Complaint as Plaintiff in the Court of Common Pleas of Mahoning County, Ohio, being Case Number 05CV 775 against Defendants, Frederick W. Hartman and Francis Hartman and others as Defendants, alleging that Defendants Frederick W. Hartman and Francis Hartman executed and delivered their certain promissory note in writing for the sum of $84,150.00, a copy of which is attached to the Complaint and made a part thereof, that Defendants, Frederick W. Hartman and Francis Hartman, are in default for all payments from February 9, 2005; that Plaintiff is a holder in due course and in possession of said note; that the balance due thereon is $91,613.52, with interest at the rate of 11.44% per annum from February 9, 2005; that to secure the payment of said note Defendants, Frederick W. Hartman and Francis Hartman, executed and delivered their mortgage deed, thereby conveying the following described premises:

Situated in the City of Struthers, County of Mahoning and State of Ohio:

And being known as being Lot Number Two Thousand One Hundred Eighty-nine (2189) according to the latest enumeration of lots in said City, formerly known as Lot No. 193 in the Grace Lyon Plat, as recorded in Volume 17 of Plats, Page 29, Mahoning County Records.

Said Lot has a frontage of Forty and Two Hundredths (40.02) feet on the South line of Elm Street and extends back on its West line One Hundred Thirty-six and Twenty-seven Hundredths (136.27) feet, and on its East line One Hundred Thirty-four and Ninety-two Hundredths (134.92) feet, having a rear line of Forty (40) feet, as appears by said Plat, be the same more or less, but subject to all legal highways.

PROPERTY LOCATION: 324 Elm Street, Struthers, Ohio 44471.

You are required to answer the Complaint within Twenty-eight (28) days from the last date of publication of this notice, which will be published for six (6) successive weeks, said answer day being the 26th day of July, 2005.

In case of your failure to answer or otherwise respond as required by the Ohio Rules of Civil Procedure, judgment by default will be rendered against you for the relief demanded in the Complaint.
