Susan Ryan, whose last known place of residence was 229 LaClede, Youngstown, Ohio 44507, otherwise whose place of residence is unknown, will hereby take notice that on the 4th day of April, 2005, Hank Conrad, filed an Amended Complaint against you in the Court of Common Pleas of Mahoning County, Ohio, being Case Number 04CV 1329 on the docket of said Court, alleging that
Plaintiff, Hank Conrad demands judgment in its favor as follows:
That judgment be entered on Count One against Defendant on the aforementioned Promissory Note in the amount of Nineteen Thousand Eight Hundred Dollars ($19,800.00), plus interest at the rate of 11% per annum;
That the mortgage set forth in Count Two be foreclosed and said premises be sold according to the statute and procedures in effect;
That the lien of Plaintiff, Hank Conrad and the liens, if any, of Defendants be marshalled and that Plaintiff's lien, interest, and costs be paid from the proceeds of the sale of said real property in the order of its respective priority;
That Allan D. Noble, and/or Cathie A. Noble, Sky Bank, and/or Mahoning County Treasurer, and/or City of Youngstown Water Department, and/or James R. Ferguson, and/or Kathleen A. Ferguson, and/or Trumbull Savings and Loan Company, and/or Susan M. Ryan be required to answer, setting up any right, title, interest, lien, or estate in and to said premises which they have, or claim to have thereon, or be forever barred from asserting the same; and
For costs and such other and further relief as is just and equitable under the circumstances.
Plaintiff further request judgment in its favor as follows:
That judgment be entered on Count Four against Defendant on the aforementioned Promissory Note in the amount of One Thousand Eight Hundred Dollars ($1,800.00), plus unpaid interest at the rate of 11% per annum;
That the mortgage set forth in Count Two be foreclosed and said premises be sold according to the statute and procedures in effect.
That the lien of Plaintiff, Hank Conrad and the liens, if any, of Defendants be marshalled and that Plaintiff's lien, interest, and costs be paid from the proceeds of the sale of said real property in the order of its respective priority;
That Defendant, Allan D. Noble, and/or Cathie A. Noble, Sky Bank, and/or Mahoning County Treasurer, and/or City of Youngstown Water Department, and/or James R. Ferguson, and/or Kathleen A. Ferguson, and/or Trumbull Savings and Loan Company, and/or Susan M. You are required to answer the Complaint within Twenty-eight (28) days from the last date of publication of this notice, which will be published for six (6) successive weeks, said answer day being the 30th day of June, 2005.
In case of your failure to answer or otherwise respond as required by the Ohio Rules of Civil Procedure, judgment by default will be rendered against you for the relief demanded in the Complaint.
