Jason S. Ingram, Jane Doe, Unknown Spouse of Jason S. Ingram, Shani L. Evans and John Doe, Unknown Spouse of Shani L. Evans, whose last known addresses are 1565 Medford Avenue, Youngstown, Ohio 44514, are hereby notified that on the 10th day of November, 2004, that Midfirst Bank filed a Complaint in the Court of Common Pleas of Mahoning County, Ohio, being Case Number 04CV 3944 against them, alleging that on the 30th day of August, 1996, Jason S. Ingram and Shani L. Evans executed to Ameristate Bancorp, Inc. a promissory note, which was subsequently assigned to Plaintiff; that Defendants, Jason S. Ingram and Shani L. Evans have defaulted in the payment of said note, and there is due Plaintiff thereon Fifty-six Thousand Two Hundred Eighty-four and 01/100 Dollars ($56,284.01) with interest at the rate of 9.25% per annum from the 1st day of May, 2004; that in order to secure the promissory note, Jason S. Ingram and Shani L. Evans executed and delivered to Ameristate Bancorp, Inc. a mortgage deed, which was subsequently assigned to Plaintiff, and conveyed the following described real estate:
Situated in the City of Youngstown, State of Ohio, and County of Mahoning and described as follows:
And known as being Youngstown City Lot No. 39766 according to the latest enumeration of lots in said City as shown in the Brownlee Woods Plat No. 1 as recorded in Volume 15, Page 86, Mahoning County Records of Plats. Said Youngstown City Lot No. 39766 has a frontage of 50 feet on the Southerly side of Medford Avenue and extends back between parallel lines 150 feet on the Easterly line, 150 feet on the Westerly line and has a rear line of 50 feet, as appears by said Plat, be the same more or less, but subject to all legal highways.

PROPERTY LOCATION: 1565 Medford Avenue, Youngstown, Ohio 44514.
Plaintiff says that said mortage was delivered to the Recorder of Mahoning County, Ohio on the 30th day of August, 1996 and was recorded in Official Record 2993, Page 327, Recorder's Office, Mahoning County, Ohio and is the first and best lien on said premises save the lien of taxes and assessments and the costs of this action.
That by reason of the failure of the Defendants Jason S. Ingram and Shani L. Evans to make the monthly payments as required, the Plaintiff has declared the entire amount due and mortgage securing such note to be absolute; that the Treasurer of Mahoning County, Ohio; Stambaugh Thompson's and City Loan Financial Services, Inc. may have a claim against said premises. Therefore, Plaintiff prays for judgment against the Defendants Jason S. Ingram and Shani L. Evans in the amount of Fifty-six Thousand Two Hundred Eighty-four and 01/100 Dollars ($56,284.01) with interest at 9.25% per annum from the 1st day of May, 2004 plus interest, late charges, advances and penalties; that the mortgage be foreclosed and all equities of redemption be forever cut off; that the Plaintiff be found to have the first and best lien therein; that the priority of all liens be determined by this Court; that said premises be sold as upon execution free and clear of all liens, interest and dower and the proceeds thereof applied to the Plaintiff's claims; and that Plaintiff may have such other and further relief to which it may be entitled at law or in equity.
Defendants first hereinabove named are further notified that they are required to answer said Complaint within Twenty-eight (28) days from the last date of publication of this notice, which will be published for six (6) successive weeks, said answer day being the 17th day of May, 2005, or judgment may be rendered as prayed for therein.
