TO: ELAINE R. RUTTINGER, whose last known place of residence was 612 Broadway Avenue, Youngstown, Ohio 44510, but whose present residence is unknown, and the unknown spouse of Elaine R. Ruttinger, if any, and the unknown heirs, next of kin, and/or guardians of Elaine R. Ruttinger, if any, Defendants in the above matter, will take notice that on the 15th day of February, 2005, Common Wealth, Inc., filed a Complaint in the Court of Common Pleas of Mahoning County, Ohio, being Case Number 05CV 567, seeking to quiet title to 618 Broadway Avenue, Youngstown, Ohio 44510, being the property abutting that of Elaine R. Ruttinger, by extinguishing the driveway easement in favor of Elaine R. Ruttinger and declaring that the Driveway Agreement establishing the common driveway across the properties is now void.

Situated in the City of Youngstown, County of Mahoning and State of Ohio and being the Westerly 40 feet of Youngstown City Lot No. 15935 according to the latest enumeration of lots in said City in William Rayen Estate Company plat, as shown by the recorded plat of said Subdivision in Volume 12 of Maps, Page 94 of Mahoning County Records.

PROPERTY LOCATION: 618 Broadway Avenue, Youngstown, Ohio 44510.

You are required to answer the Complaint within Twenty-eight (28) days from the last date of publication of this notice, which will be published for six (6) successive weeks, said answer day being the 29th day of April, 2005. In the event that Defendants fail to respond, judgment by default may be taken against them for the relief requested in the Complaint.
