DEFENDANTS.
Unknown Spouse, if any, of Edward W. Kolb and Unknown Heirs, Devisees, Creditors Legatees, Executors and Administrators, if any, of Edward W. Kolb, deceased, whose last known address is Unknown, will take notice that on the 22nd day of November, 2004, J.P. Morgan Chase Bank, N.A., successor by merger Bank One, N.A., filed its Complaint in Case Number 04CV 4095 in the Court of Common Pleas of Mahoning County, Ohio, alleging that Defendants have or claim to have an interest in the real estate commonly known as 14842 Creed Road, Diamond, Ohio 44412, and also known as Parcel Number 51-101-0-004.00-0 of the Auditor's Records of Mahoning County, Ohio. Said parcel is more particularly described in Exhibit "A" attached to Plaintiff's mortgage filed in official record book, as Volume 5169, Page 1701 on the 10th day of December, 2001 in the Recorder's Office of Mahoning County, Ohio.
The Complaint further alleges that by reason of default of the Defendant, Edward W. Kolb, deceased, in the payment of a promissory note according to its tenor, the conditions of a mortgage deed given to it to secure payment of the said note and conveying the premises described therein have been broken and the same has become absolute. The Complaint further prays that the Defendants named above be required to answer and set up their interest in said real estate or be forever barred from asserting the same, for foreclosure of said mortgage, the marshaling of any liens, and the sale of said real estate, and further that the proceeds of said sale be applied to payment of Plaintiff's claim in the proper order of its priority and for such other and further relief as is just and equitable. The real estate is more fully described below:
Situated in the Township of Milton, County of Mahoning and State of Ohio: And known as being Lot No. 1 in the Mahlon Hartman Plat No. 1, as recorded in Vol. 75 of Plats, Page 22, Mahoning County Records, and further bounded and described as follows: beginning at a point on the North line of Creed Road, said Point being 1732.5 feet West of the East line of Great Lot No. 14 in said Township; thence N 0 deg 42' W. a distance of 401.74 ft; thence due West a distance of 164.22 ft; thence S 0 deg 42' E. a distance of 251.74 feet; thence due East 39.22 ft; thence S 0 deg 42' E a distance of 150 ft, but to the North line of Creed Road; thence East along the North line of Creed Road a distance of 125 feet to the place of beginning, as appears by said Plat, subject to all legal highways.

The Defendants named above are required to answer the Complaint within Twenty-eight (28) days from the last date of publication of this notice, which will be published for six (6) successive weeks, said answer day being the 20th day of April, 2005.
