Thomas Marlowe, whose last place of residence is 14113 Ellsworth Road, Berlin Center, Ohio 44401-8753, but whose present place of residence is unknown, and Kathy Marlowe, whose last place of residence is 14113 Ellsworth Road, Berlin Center, Ohio 44401-8753, but whose present place of residence is unknown, will take notice that on the 17th day of December, 2004, Flagstar Bank, F.S.B., filed its Complaint in Case No. 04CV 4395 in the Court of Common Pleas of Mahoning County, 120 Market Street, Youngstown, OH 44503, seeking foreclosure and alleging that the Defendants Thomas Marlowe and Kathy Marlowe has or claims to have an interest in real estate described below:

Situated in the Township of Berlin, County of Mahoning and State of Ohio:

Known as being part of Great Lot No. 9 in tract No. 3 of said Berlin Township and being further bounded and described as follows:

Beginning at a point on the centerline of Ellsworth Road, said point being 3999.00 feet from a monument found at the intersection of said Ellsworth Road centerline and Duck Creek Road centerline:

1. Thence along said centerline of Ellsworth Road, North 49 degrees 49 minutes 00 seconds West a distance of 300.00 feet to a point;

2. Thence South 04 degrees 42 minutes 35 seconds West passing over an iron pin set at 36.84 feet and a total distance of 979.10 feet to an iron pin set;

3. Thence South 85 degrees 17 minutes 25 seconds East a distance of 244.31 feet to an iron pin set;

4. Thence North 04 degrees 42 minutes 35 seconds East passing over an iron pin set at 768.16 feet and a total distance of 805.00 feet to a point of beginning and containing within said bounds 5.003 acres of land, but subject to all legal highways.

PROPERTY LOCATION: 14113 Ellsworth Road, Berlin Center, Ohio 44401-8753.

You are required to answer the Complaint within Twenty-eight (28) days from the last date of publication of this notice, which will be published for six (6) successive weeks, said answer day being the 20th day of April, 2005.

In case of your failure to answer or otherwise respond as required by the Ohio Rules of Civil Procedure, judgment by default will be rendered against you for the relief demanded in the Complaint.
