Loretta Shaw, whose last known address is 566 Cleveland Street, Youngstown, Ohio 44511, and George Shaw, Jr. whose last known address is 566 Cleveland Street, Youngstown, Ohio 44511 and whose residence is unknown and, if married, the unknown spouses and, if deceased, their unknown heirs and devisees, whose addresses are unknown, will hereby take notice that on the 17th day of September, 2004, Deutsche Bank Trust Company Americas, fka Banker's Trust Company, as trustee or custodian filed its Complaint in the Common Pleas Court of Mahoning County, Ohio, being Case No. 04CV 3279 in said Court against Loretta Shaw, et al. praying for judgment of $28,577.76 with interest at the rate of 12% per annum from April 1, 2004 until paid and for foreclosure of a mortgage on the following described real estate, to wit:
Situated in the City of Youngstown, County of Mahoning and State of Ohio:
And known as being the Easterly Twenty-five (25) feet of City Lot Number Ten Thousand Two Hundred Ninety-four (10294) as lots are now numbered and enumerated in said City and as shown and platted in Plat Book Number 7, Page Number 46 of Mahoning County Records of Plats.
Said Part of City Lot No. 10294 has a frontage of Twenty-five (25) feet on the Northerly side of Cleveland Street, extends back from said Street line of even width and depth, a distance of One Hundred Forty (140) feet, and has a width of Twenty-five (25) feet in the rear, be the same more or less.
Together with the right to use a common driveway and subject to the easement granted in deed from Kathryn Lewis to J. Leo Riordan and Rosemary Riordan recorded in Volume 575, Page 456, Mahoning County Records of Deeds.
This deed is given to fulfill a certain land contract between the parties as found recorded in Volume 1233, Page 680, Mahoning County Records.
Known for street numbering purposes as 566 Cleveland Street, Youngstown, Ohio 44511
PERMANENT PARCEL NO. 53-056-079.00
and that Defendants be required to set up any interest they may have in said premises or be forever barred, that upon failure of said Defendants to pay or cause to be paid said judgment within three days from its rendition that an Order of Sale be issued to the Sheriff of Mahoning County, Ohio, to appraise, advertise, and sell said real estate, that the premises be sold free and clear of all claims, liens and interest of any of the parties herein, that the proceeds from the sale of said premises be applied to Plaintiff's judgment and for such other relief to which Plaintiff is entitled.
Said Defendants will take notice that they will be required to answer said Complaint on or before the 8th day of March, 2005, or judgment will be rendered accordingly.
