To to the defendant, Laura M. Warren, whose last known place of residence and post office address and present residence are unknown and cannot with reasonable diligence be ascertained:

Plaintiff has brought this action in the above-named Court by filing its Complaint on the 21st day of June, 2004. Defendant, Bank One, N.A., fka Bank One Columbus, N.A., Successor by Merger to Bank One, Akron, N.A. (identified in plaintiff's Complaint as Bank One, Akron, NA) has joined you as an additional party defendant in its Answer, Cross-Claim and Counterclaim filed in this case on July 12, 2004.

The object of plaintiff's Complaint is to foreclose the equity of redemption under a mortgage against the following described real estate:

Situated in the Township of Smith, County of Mahoning and State of Ohio, and known as being part of the Northeast Quarter of Section No. 13 in said Township, bounded and described as follows:

Beginning at an iron pin in the centerline of Smith-Goshen Road, 1406.38 feet South from a monument at the intersection of the centerline of Smith-Goshen Road and the centerline of Middletown Road;

Thence South 400.00 feet along the centerline of Smith-Goshen Road to a spike;

Thence West 651.00 feet to a point;

Thence South 849.80 feet to a point; thence South 89ΒΌ 37' 20" W 661.76 feet along the North line of lands now or formerly owned by R. A. Lockhart to a corner;

Thence North 1245.15 feet to an iron pin;

Thence East 1312.74 feet to the place of beginning and containing within the above described bounds 25.00 acres of land.

PROPERTY LOCATION: 11386 Smith Goshen Road, Beloit, Ohio 44609.

And for a judgment upon a promissory note executed to First Federal Savings & Loan Association of Canton, Ohio (thereafter assigned to plaintiff), by Ronald W. Smith and Cindy J. Smith.

The relief demanded is a judgment against the defendants, Ronald W. Smith and Cindy J. Smith, in the amount of Twenty-five Thousand Eighty and 79/100 Dollars ($25,080.79), with interest thereon at the rate of 10.25% per annum from June 1, 2003, until paid, plus late fees; judgment for title costs, costs for protecting the real estate and for court costs; that said mortgage may be foreclosed and the said real estate described herein be sold at Sheriff's Sale and the proceeds of said sale applied for payment of plaintiff's claim; further that defendants, Bank One, Akron, NA; Citizens Banking Company, Successor to New Waterford Bank; Arrow Financial Services, Buyer of JC Penney claim; McHutchison LLC, dba McHutchison Horticultural Distributors; Waldo & Associates, Inc.; and Laura M. Warren, be required to answer setting forth their claims or interests in the subject real estate, if any, or forever be barred from claiming or asserting same; and for such other and further relief to which plaintiff may be entitled.

You are required to answer plaintiff's Complaint within Twenty-eight (28) days from the last date of publication of this notice, which will be published for six (6) successive weeks, said answer day being the 11th day of January, 2005.

In case of your failure to answer or otherwise respond as required by the Ohio Rules of Civil Procedure, judgment by default will be rendered against you for the relief demanded in the plaintiff's Complaint.
