To the Defendants, Lucille Moody, now deceased and the Estate of Lucille Moody, if any, John Doe, Unknown Spouse, if any, of Lucille Moody, Unknown Heirs, Devisees, Legatees, Executors, Administrators, Assigns of Lucille Moody, deceased, or the Unknown Spouses, if any, of the Unknown Heirs, Devisees, Legatees, Executors, Administrators and Assigns of Lucille Moody, deceased (collectively referred to "Defendants"), whose present whereabouts are unknown and cannot, with reasonable diligence be ascertained, will take note that on the 13th day of August, 2004. Sky Bank, successor by merger to Mahoning National Bank filed its Complaint for Foreclosure ("Complaint") in the Court of Common Pleas, Mahoning County, Ohio, where the same is now pending in Case No. 04CV 2833.

The object and relief demanded in the Complaint is to foreclosure of its mortgage against the real estate owned by Lucille Moody, now deceased, in which said Defendants may claim an interest in and to, which is more fully described as follows:

Situated in the City of Youngstown, County of Mahoning and State of Ohio and known as being Youngstown City Lot No. Fifty-three Thousand Two Hundred Twelve (53212), according to the latest enumeration of lots in said City in a replat of Youngstown City Lot 53197, et al of Youngstown Steel Allotment No. 2, subdivision of a part of Original Coitsville Township Great Lot No. 6 as shown by the recorded plat of said Replat in Volume 43 of Maps, Page 202 of Mahoning County Records and being 55 feet front on the Westerly side of Berwick Avenue (formerly Florence Avenue) and extending back of equal width 114 feet as appears by said Plat, be the same more or less, but subject to all legal highways.

You are required to answer the Complaint within twenty-eight days after the last publication of this notice, which will be published once each week for six successive weeks, said answer day being the 4th day of January, 2005, or you may be denied a hearing in this case.

In case of your failure to answer or otherwise respond as permitted by the Ohio Rules of Civil Procedure within the time stated, judgment by default will be rendered against you for the relief demanded in the Complaint.
