DEFENDANTS.
Bryce Hines, whose place of residence is unknown and whose last known address is 2384 Chaney Circle, Youngstown, Ohio 44509 and who cannot be served within the State of Ohio, will take notice that on the 7th day of September, 2004, Deutsche Bank National Trust Company, filed a Complaint as Plaintiff in the Court of Common Pleas of Mahoning County, Ohio, being Case Number 04CV 3138 against Bryce Hines and others as Defendants, alleging that Defendant Bryce Hines executed and delivered his certain promissory note in writing for the sum of $50,000.00, a copy of which is attached to the Complaint and made a part thereof, that Bryce Hines is in default for all payments from May 1, 2004; that Plaintiff is a holder in due course and in possession of said note; that the balance due thereon is $51,426.69 with interest per annum from May 1, 2004; that to secure the payment of said note Bryce Hines executed and delivered their mortgage deed, hereby conveying the following described premises:
Situated in the City of Youngstown, County of Mahoning and State of Ohio:
And known as being all of Youngstown City Lot Number 59188 to the latest enumeration of Lots in said city, as shown by the plat recorded in Volume 40 of MAPS, Pages 56 or 57, Mahoning County Records.
Said Youngstown City Lot Number 59188 being further described as having a frontage of 55.36 feet along a curved line on the westerly side of Chaney Circle and extending back along the southerly line, a distance of 182 feet and having a rear line of 143 feet. Be the same more or less, but subject to all legal highways.

that said note is in default, whereby the conditions set forth in said note and mortgage have been broken, said mortgage deed has become absolute and Plaintiff is entitled to have said mortgage foreclosed, said premises sold, and the proceeds applied in payment of Plaintiff's claims; that Defendants Mahoning County Treasurer, Mahoning County Clerk of Courts, may have or claim to have some interest in or lien upon said premises; that all of said Defendants be required to set forth any claim, lien or interest in or upon the above described premises which he or she may have or be forever barred therefrom; that therefore Plaintiff demands judgment against Defendant Bryce Hines in the amount to $51,426.69 with interest per annum from May 1, 2004, together with its disbursements and advancements for taxes, insurance and matters related to said premises and its costs herein expended; that Plaintiff's mortgage be declared to be a valid and subsisting first and best lien upon said premises; that its mortgage be foreclosed; that all liens upon said premises be marshaled; that the equity of redemption of all Defendants, be forever cut off and barred and said premises sold as upon execution in accordance with law; that upon the sale of said premises the proceeds be paid to Plaintiff to satisfy the amount of its existing lien and the interest, together with its disbursements, further relief to which may be entitled in equity or at law.
Deftendant Bryce Hines is further notified that he is required to answer the Complaint within Twenty-eight (28) days from the last date of publication of this notice, which will be published for six (6) successive weeks, said answer day being the 22nd day of December, 2004.
In case of your failure to answer or otherwise respond as required by the Ohio Rules of Civil Procedure, judgment by default will be rendered against you for the relief demanded in the Complaint.
