Public notice is hereby given to: ANGELINE MORELL, whose last known address is 2030 North State Line Road, Hubbard, OH 44425, and whose address cannot be ascertained, that on the 15th day of April, 2004, The Bank of New York (Plaintiff), filed a Complaint in Case Number 04CV 1572 in the Mahoning County Court of Common Pleas, Youngstown, Ohio for the foreclosure of the lien for delinquent real estate taxes, assessments, penalties, interest, and charges against certain real property.

Situated in the City of Struthers, County of Mahoning, State of Ohio, and known as being Lot Number Five Hundred Eighty-one (581) according to the latest enumeration of lots in said City, as recorded in Volume 4 of Plats, Page 43, Mahoning County Records.

Said lot has a frontage of Fifty (50) feet on the southerly line of Spring Street and extends back on its easterly line One Hundred Fifty (150) feet, and on its westerly line One Hundred Fifty (150) feet, having a rear line of Fifty (50) feet, as appears by said plat, subject to all legal highways.

Current deed recorded on 6/29/93 in Volume 1944, Page 58.

PROPERTY LOCATION: 48 Spring Street, Struthers, OH 44471.

ANGELINE MORELL may file an answer in this case setting forth any interest she has in this property. The answer must be filed in the office of the Mahoning County Clerk of Courts and a copy must be served on Penny E. Loucas, Esq., 1370 Ontario Street, Suite 1700, Cleveland, OH 44113-1726 Twenty-eight (28) days from the last date of publication of this notice, which will be published for six (6) successive weeks, said answer day being the 23rd day of September, 2004.

If ANGELINE MORELL fails to appear in this action and defend herself, a Default Judgment will be taken against her for the relieve demanded in the complaint.

If the parcel(s) is/are sold for an amount that is less than the amount of the delinquent taxes, assessments, charges, penalties and interest against them, the Court, in a separate order, may enter a deficiency judgment against the owner of record of the parcel(s) for the amount of the difference; if that owner is a corporation, the Court may enter the deficiency judgment against the stockholder holding a majority of the corporation's stock.

In case of your failure to answer or otherwise respond as required by the Ohio Rules of Civil Procedure, judgment by default will be rendered against you for the relief demanded in the Complaint.
