DEFENDANTS.

The Unknown Heirs, Beneficiares, Donees and Fiduciaries of Steven E. Mulichak, if he be deceased whose last known addresses are unknown are hereby notified that Midfirst Bank, filed a Complaint in the Court of Common Pleas of Mahoning County, Ohio, being Case Number 04CV 861 against them, alleging that on the 15th day of April, 1994, Steven E. Mulichak executed to The Home Mortgage Company, Inc. a promissory note, which was subsequently assigned to Plaintiff; that Defendant Steven E. Mulichak has defaulted in the payment of said note, and there is due Plaintiff thereon Thirty-four Thousand Four Hundred Seventy-eight and 52/100 dollars ($34,478.52) with interest at the rate of 9% per annum from the 1st day of August, 2003; that in order to secure the promisory note, Steven E. Mulichak executed and delivered to The Home Mortgage Company, Inc. a mortgage deed, which was subsequently assigned to Plaintiff, and conveyed the following described real estate:

Situated in the City of Youngstown, County of Mahoning and State of Ohio:

And known as being Youngstown City Lot No. 35217, according to the latest enumeration of lots in said City in Cochran Park East Subdivision No. 1, a Subdivision of a part of Original Youngstown City Out Lot Nos. 1197 and 1200, as shown by the recorded plat of said Subdivision in Volume 19 of Maps, Page 95 of Mahoning County Records, be the same more or less, but subject to all legal highways.

PROPERTY LOCATION: 858 East Boston Avenue, Youngstown, Ohio 44502.

Plaintiff says that said Mortgage was delivered to the Recorder of Mahoning County, Ohio on the 15th day of April, 1994 and was recorded in Official Record 2222, Page 12, Recorder's Office, Mahoning County, Ohio and is the first and best lien on said premises save the lien of taxes and assessments and the costs of this action.

That by reason of the failure of the Defendant Steven E. Mulichak to make the monthly payments as required, the Plaintiff has declared the entire amount due and mortgage securing such note to be absolute; that the Treasurer of Mahoning County, Ohio; may have a claim against said premises. Therefore, Plaintiff prays for judgment against the Defendant Steven E. Mulichak in the amount of Thirty-four Thousand Four Hundred Seventy-eight and 52/100 Dollars ($34,478.52) with interest at 9% per annum from the 1st day of August, 2003 plus interest, late charges, advances and penalties; that the mortgage be foreclosed and all equities of redemption be forever cut off; that the Plaintiff be found to have the first and best lien therein; that the priority of all liens be determined by this Court; that said premises be sold as upon execution free and clear of all liens, interest and dower and the proceeds thereof applied to the Plaintiff's claims; and that Plaintiff may have such other and further relief to which it may be entitled at law or in equity.

Defendants first hereinabove named are further notified that they are required to answer said Complaint within Twenty-eight (28) days from the last date of publication of this notice, which will be published for six (6) successive weeks, said answer day being the 1st day of September, 2004.
