To the Defendants, Michael E. Miller, deceased, the Unknown Spouse, if any, of Michael E. Miller, deceased, the Unknown Heirs, Devisees, Legatees, Executors, Administrators, Assigns, the Unknown Spouses, if any, of the Unknown Heirs, Devisees, Legatees, Executors, Administrators and Assigns of Michael E. Miller, deceased, and the Unknown Occupants, if any, of 479 Clearmont Drive, Youngstown, Ohio 44511 (collectively referred to "Defendants"), whose present whereabouts are unknown and cannot, with reasonable diligence be ascertained, will take notice that on the 4th day of March, 2004, Sky Bank, successor by merger to Mahoning National Bank filed its Complaint for Foreclosure ("Complaint") in the Court of Common Pleas, Mahoning County, Ohio, where the same is now pending in Case No. 04CV 00789. The object of the Complaint is to foreclose upon a mortgage against the real estate currently owned by Defendant Michael E. Miller, now deceased, referred to in Count Two of the Complaint and described as:

Situated in the City of Youngstown, County of Mahoning and State of Ohio:

And known as being Youngstown City Lot No. 24114 according to the latest enumeration of lots in said City, formerly Plat Lot No. 123, in Stambaugh Heights No. 2 subdivision of a part of original Youngstown Township Great Lot No. 1 as shown by the recorded plat of said Subdivision in Volume 11 of Maps, Page 30 of Mahoning County Records and being 50 feet front on the Southerly side of Clearmont Drive and extending back 234.33 feet on the Easterly line, 234.17 feet on the Westerly line and having a rear line of 50 feet as appears by said Plat, be the same more or less.

PERMANENT PARCEL NO. 53-125-0-383.00

The relief demanded is foreclosure of Plaintiff's Mortgage lien interest and sale of the property in payment of the principal and interest balance due and owing on a Multistate Fixed Rate Note executed by Defendant Michael E. Miller, now deceased, with an outstanding balance due of Eighteen Thousand Nine Hundred Forty-six and 38/100 Dollars ($18,946.38) plus interest at the fixed rate of 9.75000% per annum from February 21, 2004, plus late charges, costs of this action, costs of title work and future expenses as may be advanced by Sky Bank under the terms of its mortgage and for such further relief to which Sky Bank may be entitled.

You are required to answer the Complaint within 28 days after the last publication of this notice, which will be published once each week for six (6) successive weeks, said answer day being the 4th day of August, 2004.

In case of your failure to answer or otherwise respond as permitted by the Ohio Rules of Civil Procedure within the time stated, judgment by default will be rendered against you for the relief demanded in the Complaint.
