ROSA PEREZ AND JOHN DOE, UNKNOWN SPOUSE, IF ANY OF ROSA PEREZ, WHOSE PRESENT WHEREABOUTS ARE UNKNOWN and cannot, with reasonable diligence be ascertained, will take note that on the 26th day of August, 2003, Plaintiff Sky Bank, successor by merger to Mahoning National Bank filed its Complaint for Foreclosure ("Complaint") in the Court of Common Pleas, Mahoning County, Ohio, where the same is now pending in Case No. 03CV 2937. The object of the Complaint is to foreclose on mortgage against real estate currently owned by Defendant, Rosa Perez, referred to in Count Two of the Complaint and described as:

Situated in the City of Youngstown, County of Mahoning and State of Ohio, and known as being City Lot Number 14035 as Lots are now numbered in said City, and as shown by a plat recorded in Volume 10 at Page 119, Mahoning County Records of Maps.

Said Lot Number 14035 is bounded as follows: Beginning at a point in the North line of Rigby Street, 160 feet West of the West line of Byron; thence North parallel with Byron Street, 120 feet; thence East parallel with RigBy Street 10 feet to a point; thence North parallel with Byron Street 10 feet to a point; thence East parallel with Rigby Street 30 feet to the Northwest corner of City Lot Number 14031; thence South by the West line of City Lot Number 14031 and 14034 to the North line of Rigby Street; thence West by the North line of Rigby Street 40 feet to the place of beginning, be the same more or less, but subject to all legal highways.

Known for street numbering purposes as 1352 Rigby Street, Youngstown, Ohio 44506

PERMANENT PARCEL NO. 53-033-0-150.00

The relief demanded is foreclosure of Plaintiff's Mortgage lien interest and sale of the property in payment of the principal and interest balance due and owing on Note Number 77032854 executed by Defendant, Rosa Perez, with an outstanding balance due of Eight Thousand Two Hundred Ninety-seven and 08/100 Dollars ($8,297.08) plus interest thereon at the fixed rate of 8.000% per annum from August 14, 2003, plus late charges, costs of this action, costs of title work and future expenses as may be advanced by Plaintiff, Sky Bank, under the terms of the mortgage and such further relief to which Plaintiff, Sky Bank, may be entitled.

You are required to answer the Complaint within twenty-eight days after the last publication of this notice, which will be published once each week for six successive weeks, said answer day being the 11th day of May, 2004, or you may be denied a hearing in this case.

In case of your failure to answer or otherwise respond as permitted by the Ohio Rules of Civil Procedure within the time stated, judgment by default will be rendered against you for the relief demanded in the Complaint.
