TO THE DEFENDENTS, BRIAN S. KENNEDY, LISA M. KENNEDY, TAMMY BAILING AND BRIAN BAILING, whose present whereabouts are unknown and cannot, with reasonable diligence be ascertained, will take note that on the 18th day of March, 2003, Plaintiff, Sky Bank, successor by merger to Mahoning National Bank filed its Complaint for Foreclosure ("Complaint") in the Court of Common Pleas, Mahoning County, Ohio where the same is now pending in Case No. 03 CV 883. The object of the Complaint is to foreclose on mortgage against real estate currently owned by Defendants, Anthony J. Frengel and Rachael M. Frengel, referred to in Count Two of the Complaint and described as:

Situated in the City of Youngstown, County of Mahoning and State of Ohio, and known as being Youngstown City Lot No. 44114, according to the latest enumeration of lots in said City, in Replat of Lots 19-32 inclusive and 48, 49 and 50 of the Brownlie Business Allotment, a Subdivision of a part of Original Boardman Township Great Lot 2, 3rd Division, as shown by the recorded plat of said Subdivision in Volume 23 of Maps, page 77 of Mahoning County Records.

Said Youngstown City Lot No. 44114 has a frontage of 47 feet on the Northerly side of Vermont Avenue, and extends back 147.92 feet on the Easterly line, 148.06 feet on the Westerly line and has a rear line of 47 feet, be the same more or less, but subject to all legal highways.

Known for street numbering purposes as 26 Vermont Avenue, Youngstown, Ohio 44512

PERMANENT PARCEL NO. 53-198-0-096.00

The relief demanded is foreclosure of Plaintiff's Mortgage lien interest and sale of the property in payment of the principal and interest balance due and owing on Note Number 77028296 executed by Defendant, Anthony J. Frengel and Rachael M. Frengel with an outstanding balance due of Fifty-seven Thousand Six Hundred Eighty-seven and 10/10 Dollars ($57,687.10) plus interest thereon at the current variable rate of 6.5000% per annum from March 10, 2003, plus late charges, costs of this action, costs of titlework and future expenses as may be advanced by Plaintiff, Sky Bank under the terms of the mortgage and such further relief to which Plaintiff, Sky Bank may be entitled.

You are required to answer the Complaint within twenty-eight days after the last publication of this notice, which will be published once a week for six (6) successive weeks, said answer day being the 7th day of August, 2003, or you may be denied a hearing in this case.

In case of your failure to answer or otherwise respond as permitted by the Ohio Rules of Civil Procedure within the time stated, judgment by default will be rendered against you for the relief demanded in the Complaint.
