DEFENDANTS.

The unknown heirs, devisees, legatees, executor, administrator and assigns of Robert Shortman, Jr. and Lovetta Daisy Shortman, whose last known address was unknown, and upon whom service of summons cannot be made, because the residence and all other addresses of said defendants are unknown and cannot with reasonable diligence be ascertained, are hereby notified that on the 6th day of February, 2002, the plaintiff filed a Complaint in the Court of Common Pleas of Mahoning County, Ohio, in Case Number 02CV 366 against Robert Shortman, Jr., Lovetta Daisy Shortman, Commercial Finance Corporation and the Mahoning County Treasurer, as defendants, alleging that on April 1, 1983, defendants, Robert Shortman, Jr and Lovetta Daisy Shortman, both now deceased, executed and delivered to The Dollar Savings and Trust Company, nka National City Bank a promissory note; that defendants, Robert Shortman, Jr. and Lovetta Daisy Shortman, both now deceased, have defaulted in the payment of said note and there is due $6,022.46 with interest thereon from April 15, 2001, at 14.00% per annum; that as security for the payment of said note, defendants, Robert Shortman, Jr. and Lovetta Daisy Shortman, now both deceased, executed and delivered to The Dollar Savings and Trust Company, nka National City Bank, a mortgage deed for the residence at 5825 Water Street, Poland, Ohio, aka 5825 Poland-Struthers Road, Poland, Ohio, conveying the following described premises, situated in the City of Struthers, County of Mahoning, and State of Ohio and bound and described as follows, to-wit:

Struthers City Lot No. 6525, as lots are now known in said City, formerly known as the south 63 feet of Lot No. 1 of Stephen Stanec Plat as recorded in Volume 32, Page 184, Mahoning County Records. Said part of said lot fronts 63 feet on the east side of Poland Avenue and extends back, of even width, 241.42 feet.

PROPERTY LOCATION: 5825 Water Street aka 5825 Poland-Struthers Road, Struthers, OH 44471.

That the defendants, Robert Shortman, Jr. and Lovetta Daisy Shortman, both now deceased, have failed to pay said note according to the terms and conditions thereof; that defendants, Commercial Finance Corporation successor to Dollar Savings and Trust Company, Robert Shortman, Lovetta Shortman, the unknown heirs, devisees, legatees, executor, administrator and assigns of Robert Shortman, Jr. and Lovetta Daisy Shortman and the Mahoning County Treasurer, may claim to have some interest in said real property; therefore, plaintiff demands there be found due and owing upon the Note the sum of $6,022.46 with interest thereon at 14.00% per annum from April 15, 2001; that said mortage be foreclosed; that the amount of liens on the property be marshalled; that the real property be sold and the amount due plaintiff be paid from the proceeds of the sale, together with costs herein; that defendants, Commercial Finance Corporation successor to Dollar Savings and Trust Company, Roberta Shortman, Lovetta Shortman, the unknown heirs, devisees, legatees, executor, administrator and assigns of Robert Shortman, Jr. and Lovetta Daisy Shortman and the Mahoning County Treasurer, be required to set up their liens or interest in said real property or be forever barred from asserting the same and for attorneys fees and costs.

The defendants first hereinabove named are further notified that they are required to answer said complaint on or before the 24th day of January, 2003 which includes 28 days from the last publication or judgment may be rendered as demanded therein.

In case of your failure to answer or otherwise respond as required by the Ohio Rules of Civil Procedure, judgment by default will be rendered against you for the relief demanded in the Complaint.
