THE BANK OF NEW YORK, ACTING SOLELY IN ITS CAPACITY AS TRUSTEE FOR EQCC TRUST 2001-1F, C/O FAIRBANKS CAPITAL CORPORATION

KATHERINE E. HARRIS, ET AL.,

DEFENDANTS.

Jane Doe, unknown spouse of Henry Harris on June 17, 1994 and John Doe, unknown spouse of Adrienne Harris on December 1, 1998, whose last known address is unknown, all of whose residences are unknown and cannot by reasonable diligence be ascertained, will take notice that on the 28th day of August, 2002, The Bank of New York, acting solely in its capacity as Trustee for EQCC Trust 2001-1F, c/o Fairbanks Capital Corporation filed its Complaint in the Common Pleas Court of Mahoning County Ohio in Case No. 02CV 2606 on the docket of the Court, and the object and demand for relief of which pleading is to foreclose the lien of plaintiff's mortgage recorded upon the following described real estate, to wit:

PROPERTY LOCATED AT: 415 West Earle Avenue, Youngstown, OH 44511 and being more particularly described in plaintiff's mortgage recorded in Mortgage Book Official Records Volume 5067, Page 298, of this County Recorder's Office.

PERMANENT PARCEL NOS. 53-058-0-404 and 53-058-0-405

All of the above named defendants are required to answer within twenty-eight (28) days after last publication, which shall be published once a week for six consecutive weeks, said answer day being the 27th day of December, 2002, or they might be denied a hearing in this case.
