To the Defendant, Christan Michelle Rupe, whose present whereabouts are unknown and cannot, with reasonable diligence be ascertained, will take note that on July 8, 2002, Plaintiff, Sky Bank (hereinafter "Sky Bank" filed its Complaint for Foreclosure ("Complaint") in the Court of Common Pleas, Mahoning County, Ohio where the same is now pending in Case No. 02CV 2016. The object of the Complaint is to foreclose on a Mortgages I and II against real estate owned by Matthew R. Rupe referred to in Count Two of the Complaint and described as:

Situated in the City of Struthers, County of Mahoning and State of Ohio and known as being Lot No. Four Thousand Five hundred Sixty-eight (4568) and Four Thousand Five hundred Sixty-nine (4569) according to the latest enumeration of lots in said City, formerly known as Lots No. 88 and 89 in the Yellow Creek Park Allotment, as recorded in Volume 18 of Plats, Page 197, Mahoning County Records.

Said lots taken together form a parcel of land which has a frontage of Sixty (60) feet on the northerly line of Haywood Boulevard and extends back on their westerly line One Hundred Thirty (130) feet, and on their easterly line One Hundred Thirty (130) feet, having a combined rear line of Sixty (60) feet, as appears by said plat.

Known for street numbering purposes as 11 West Haywood Street, Struthers, Ohio 44471

PERMANENT PARCEL NOS. 38-023-0-257 and 38-023-0-256

The relief demanded is that the Court find that there is due and owing on the Note I referred to in Count I, of the Complaint, and executed by Matthew R. Rupe, the sum of Sixty-one Thousand Five Hundred Ninety-seven and 19/100 Dollars ($61,597.19) plus interest at the rate of 7.2500% per annum from June 11, 2002, late charges, advances, costs of this action, costs of titlework, future expenses as may be advanced by Plaintiff Sky Bank under the terms of the Mortgage I and such further relief to which Plaintiff Sky Bank may be entitled.

Further the relief demanded is that the Court find that there is due and owing on the Note II referred to in Count III, of the Complaint, and executed by Matthew R. Rupe, the sum of Twelve Thousand Five Hundred Twenty-eight and 54/100 Dollars ($12,528.54) plus interest at the rate of 9.7500% per annum from June 11, 2002, late charges, advances, costs of this action, costs of titlework, future expenses as may be advanced by Plaintiff Sky Bank under the terms of the Mortgage II and such further relief to which Plaintiff Sky Bank may be entitled.

You are required to answer the Complaint within twenty-eight days after the last publication of this notice, which will be published once each week for six successive weeks, said answer day being the 7th day of November, 2002, or you may be denied a hearing in this case.

In case of your failure to answer or otherwise respond as permitted by the Ohio Rules of Civil Procedure within the time stated, judgment by default will be rendered against you for the relief demanded in the Complaint.
