The following parties, namely: (1) Unknown Transferees, Assigns, Executors, Administrators, Heirs and Devisees of Genevieve Pecchio, Deceased, Addresses Unknown; (2) Unknown Transferees, Assigns, Executors, Administrators, Heirs and Devisees of Daniel Pecchio, Deceased, Addresses Unknown, will take notice that they have been named as defendants by Gordon Proctor, Director Ohio Department of Transportation, who instituted a case now pending in the Common Pleas Court of Mahoning County, Ohio, which is an action to appropriate certain property for highway purposes, namely the making, constructing, or improving of State Route 711, Section 1.70/0.00 and to fix the value of said property.

The property sought to be appropriated is more specifically described as follows:

MAH/TRU-711-1.70/0.00

ALL RIGHT, TITLE AND INTEREST IN FEE SIMPLE

IN THE FOLLOWING DESCRIBED PROPERTY

IN THE NAME, AND FOR THE USE OF THE CITY OF YOUNGSTOWN, OHIO

Situated in the City of Youngstown, County of Mahoning, State of Ohio, and in Section 17, Township 2N, Range 2W, and bounded and described as follows:

And known as being part of City Lot No. 8945 according to the latest enumeration of lots in said city, in a replat of Davis Brothers Addition to Brier Hill, as shown by the recorded plat of said replat in Volume 7 of Maps, Page 54, Mahoning County Records. Said part of City Lot 8945 has frontage of thirty (30) feet on the northeasterly side of West Federal Street and extends back therefrom between parallel lines, a distance of One Hunderd & Forty-five (145) feet.

Prior Instrument Reference: Vol. 975, Page 377, Mahoning County's Recorder's Office.

Being 0.100 acres, more or less, of which the present road occupies 0.000 acres, more or less, and being all of Auditor's Parcel 53-097-0-032.

It is intended that Parcel 201-WDV comprise all of that real property conveyed to Genevieve Pecchio, as recorded in Deed Volume 975, at Page 377, Mahoning County Recorder's Office.

Pursuant to Civil Rule 12(A)(1), said persons mentioned above shall take further notice that they have 28 days after the completion of the Service by Publication within which to answer or otherwise defend against Plaintiff's petition.

The original of any such answer or other pleading defending against Plaintiff's petition must be filed with Anthony Vivo, the Clerk of the Common Pleas Court of Mahoning County, Ohio, whose office is located at the Mahoning County Courthouse, 120 Market Street, Youngstown, Ohio. A copy of any such answer or other pleading defending against Plaintiff's petition must be served upon Plaintiff's attorney, namely: John Thorne, Assistant Attorney General, at 615 West Superior Avenue, State Office Building, 11th Floor, Cleveland, Ohio 44113-1899.

A failure to answer or otherwise defend within said 28 days will result in Plaintiff, pursuant to Civil Rule 55, asking the Court to grant a judgment by default against any such person who fails to answer or otherwise defend.
