RICHARD BURNS, JANE DOE, Unknown Spouse, if any, of RICHARD BURNS, whose last place of residence is known as 392 Main Street, Poland, Ohio 44514, but whose present place of residence is unknown, will take notice that on the 12th day of April, 2002, Washington Mutual Bank, F.A. filed its Complaint in Case No. 02CV 1071 in the Court of Common Pleas, Mahoning County, Ohio, alleging that the Defendants, RICHARD BURNS, JANE DOE, Unknown Spouse, if any, of RICHARD BURNS, have or claim to have an interest in the real estate described below:
PARCEL NO. 1:
Situated in the Village of Poland, County of Mahoning, State of Ohio, and known as being Lot Number One Thousand Two Hundred (1200) according to the latest enumeration of lots in said Village, as recorded in Volume 83 of Plats, Page 204, Mahoning County Records.
PARCEL NO. 2:
Situated in the Township of Poland, County of Mahoning, State of Ohio, and known as being a part of Great Lot Number Four (4) of said Township, and being a strip of land One Hundred (100) feet wide, and Fifty (50) feet on each side of the following described center line: Beginning at a point on the west line of said Great Lot No. 4 about 191 feet northerly measured along said Great Lot line from the southwesterly corner of said Great Lot No. 4, said beginning being also the point where the center line of the right-of-way of The Mahoning & Shenango Railway and Light Company intersects the west line of said Great Lot No. 4; thence S. 85¼ 32' E. 38 feet; thence S. 70¼ 05' E. 532.5 feet; thence 50 feet north of and parallel to the south line of said Great Lot No. 4 S. 85¼ 59' E. to the west line of lands of Robert and Marie Freiheit as set forth in deed from Floyd B. Hutchison, et al to said Robert and Marie Freiheit, recorded in Volume 459, Page 348, Mahoning County Records of Deeds and containing 4.106 acres, be the same more or less, but subject to all legal highways.
NOTE: Said premises are now known as Poland Village Lot Number Seven Hundred Six (706) according to the latest enumeration of lots in said village.

The Petitioner further alleges that by reason of default of the Defendant(s) in the payment of a promissory note, according to its tenor, the conditions of a concurrent mortgage deed given to secure the payment of said note and conveying the premises described, have been broken, and the same has become absolute.
The Petitioner prays that the Defendant(s) named above be required to answer and set up their interest in said real estate or be forever barred from asserting the same, for foreclosure of said mortgage, the marshalling of any liens, and the sale of said real estate, and the proceeds of said sale applied to the payment of Petitioner‘s claim in the proper order of its priority, and for such other and further relief as is just and equitable. THE DEFENDANT(S) NAMED ABOVE ARE REQUIRED TO ANSWER ON OR BEFORE THE 8th DAY OF OCTOBER, 2002.
